Bush’s May 3 visit sued the city and its police chief Tuesday, claiming the ordinance violated their First Amendment rights. The city requires people who want to demonstrate to apply for a permit 15 days in advance, state the purpose of the march and the number of people and kinds of material that will be involved, the lawsuit Filed in U.S. District Court in Waco said. He cannot pick and choose who he wants to protest. That’s unconstitutional.” The five had not applied and did not have a permit to protest, said the Texas Civil Rights Project, which Harrington directs. Crawford Police Chief Donnie Tidmore said he had not seen the lawsuit and could not comment on it. He said the ordi nance, in effect since 2001, has worked well. Tidmore said the advance notice is required for scheduling purposes and said some permit requests have been denied because they were not submitted in a timely manner. He also said some permits have been granted for events scheduled the day of the request. “I will work with any group,” Tidmore said. “1 am flexible.” The ordinance was based on policies of larger police depart ments and various parts of it “legal observers.” A fifth person was arrested later when arrived at the scene to see what was happening, Harrington saii The five were held overnight jail. “They were not even ing,” Harrington said. Officials with Washington, D.C.-based Physicians for Social Responsibility are urging Texas residents, officials and politicians to invest more in renewable energy sources such as wind, solar and biomass. Robert Musil, executive director of the nonprofit group, said Texas’ problem is that it relies on nearly 90 percent of its total energy needs on fossil fuels such as coal, oil and gas. “Texas is in an old-fashioned energy mold,” Musil said at a news conference Tuesday. “Dirty power in Texas has led to death and disease.” The group’s report, “Degrees of Danger: How Smarter Energy Choices Can Protect the Health of Texans,” says that since 1995, Texas has emitted close to twice as much carbon dioxide as any other state and that if Texas were an independent nation, it would rank seventh in the world in carbon dioxide production, the same as the United Kingdom, which has more than three times the population.
