Penn's law suit, filed Tuesday in state Superior Court, claims his public views questioning U.S. policy toward Iraq prompted Bing to renege on a S10 million "play or pay" oral agreement. Bing's lawsuit denies there was a deal to pay Penn the $10 mil lion whether or not the movie was actually filmed. Penn's lawyers say Bing retract ed the agreement because he feared adverse publicity after Penn visited Iraq in December. Penn had publicly questioned before and after the trip whether sufficient danger had been proven by the United States prompt "the likely horrors of war in Iraq," Penn's lawsuit said Bing's lawsuit seeks $15 rr It accuses the actor of attempting to extort $10 million from through an alleged threat to pub licly embarrass Bing by saying a political disagreement between the two had kept him from mail ing the movie. Bing and his company, Shangri- La Entertainment, said in their lawsuit that they have invested millions of dollars in efforts make the film.
