DALLAS — Taxpayers suing school dis
tricts over the state’s school finance system
are fighting a Dallas judge’s decision to
move their litigation to Austin.
The taxpayers sued Highland Park,
Richardson, Irving and Dallas school dis
tricts, arguing that the so-called Robin Hood
system is unconstitutional because it is
essentially a statewide property tax. Forty-
two property-poor districts joined the defen
dants in the suit as “interveners.”
In a hearing Wednesday before the Fifth
District Court of Appeals, the plaintiffs said
they deserve to have the suit heard in Dallas
County, where they live and where the orig
inal four defendants are located.
In October, State District Judge Anne
Ashby transferred the case to Travis County
and combined it with similar suits.
Jeff Boyd, a lawyer with the state
Attorney General’s office, told the three-jus
tice appeals panel that Travis County is the
appropriate venue because the case has
statewide impact.
“This is a suit asking for a court to say
the whole statewide school system is uncon
stitutional,” Boyd said. “The suit has noth
ing to do with Dallas.”
But plaintiff David Hopson said taxpay
ers have not directly sued a state entity. In
addition, he said, the case may be set on
more neutral ground in Dallas because sim
ilar suits tried in Austin have failed.
“Conventional wisdom says Travis
County has been unfair to taxpayers in school
finance suits,” said Hopson, .who has a
