NEW YORK (AP) — Samuel Waksal, the
jet-setting scientist who founded ImClone
Systems, pleaded guilty Tuesday in the insid
er-trading scandal that threatens his friend
Martha Stewart and her home-decorating
empire.
Waksal, 55, became the second person to
plead guilty in the federal investigation into
trading of the biotechnology company’s
stock. He did not implicate Stewart in his plea,
and the plea was not part of an agreement to
cooperate with authorities.
He remains free on bail until his sentenc
ing in January. The charges carry up to 65
years in prison and millions of dollars in fines.
But his sentence would probably be far less
under federal guidelines.
Prosecutors warned they may bring more
charges against Waksal.
Waksal was arrested in June on charges of
passing along infonnation that the FDA had'
decided not to review his company’s experi
mental cancer drug, Erbitux — news that sent
the stock plummeting.
Stewart sold nearly 4,000 ImClone shares
on Dec. 27, the day before the FDA
announced its Erbitux decision. She has main
tained she had a standing order to sell the
stock if it dropped below $60.
An assistant to Bacanovic, Douglas
Faneuil, backed Stewart’s account, but later
admitted he withheld information when first
interviewed by investigators.

and securities fraud in a scheme to tip off his daughter. Aliza, to unload ImClone
stock before it plunged on bad news from the Food and Drug Administration. The
scandal also threatens his friend Martha Stewart.

keep quiet about Stewart’s stock sale. He
agreed to testify against Stewart and others if
they are charged.
Waksal was a colorful figure in the most
ly staid pharmaceutical industry. Along with
a doctorate in immunobiology, he has a $20
million art collection, including a Picasso,
and a circle of friends that includes rock star
Mick Jagger.

city’s fonner mayor and two
other men declined to testify
Tuesday in their own defense in
a murder trial for the 1969 slay
ing of a young black woman
during race riots.
Instead, the all-white jury
will have to base its decision on
the testimony of more than 80
witnesses. The jurors are expect
ed to get the case before the end
of the day Thursday.
York’s former Mayor Charlie
Robertson, 68, and two others
are charged in the murder of
Lillie Belle Allen, a South
Carolina woman who was visit
ing relatives in York when
blacks and whites erupted into
rioting in July 1969.
Allen was shot to death in a
white neighborhood when a car
carrying her and several family
members stalled at a railroad
crossing. Robertson, who was
then a policeman, is charged
with handing out ammunition to
white gangs and urging them to
exact revenge for the earlier
killing of a white police officer.
While Robertson has admit
ted that he shouted “white
power’’ at the rally before the
slaying, he denied the accusa
tions and has apologized for his
behavior, saying he no longer
harbors racist beliefs.
If convicted, the men could
get up to life in prison.

Uhler that he declined to testify
“under the advice of my attor
neys.’’
