Prosecutors had sought to charge the assistant, Douglas Fans with a felony of making false statements to investigators but agreed to a misdemeanor in exchange for his cooperation,the newspaper said, citing people familiar with the discussionswh-1 did not identify. The charge is expected to be filed within days, the newspapei. Through his lawyer, Faneuil declined to comment, as did the U.S. attorney's office in New York. A spokeswoman for Stewar declined to comment, but in the past she has denied wrongs Merrill Lynch handled Stewart's sale of nearly 4,000 ImClone shares in late December, shortly before the company announce that federal regulators would not review the company's cance drug, Erbitux. ImClone founder Samuel Waksal has been accused of using knowledge of the FDA's impending announcement to tip off - friends, including home decor maven Stewart, and his family I members, who sold their stock before the price plummeted I Stewart, who has been accused of insider trading in the stool sale, has said she had a standing order with her broker, Petet I Bacanovic — for whom Faneuil worked — to sell the ImClone shares if they fell below $60. Faneuil, 26, initially gave invest^ tors the same account, but later changed his story and saidth? had been no such order. The misdemeanor charge involves a gift Faneuil acceptedfe- Bacanovic, allegedly in exchange for corroborating the accoum about the stop-loss order to the federal investigators. It isn't certain that charges will be filed against Stewart, and people familiar with the investigation said no charges are "ir nent," the newspaper said. Waksal pleaded innocent last month to charges of securities I fraud, perjury, bank fraud and obstruction of justice. ImClonesj also suing him. Titanic to give up rights, will not conduct expeditions on shipwreck site NORFOLK, Va. (AP) — The struggling company that hassalv the Titanic for the past 15 years says it is giving up its rightsterl shipwreck and will no longer conduct expeditions to the site I R.M.S. Titanic Inc. of Atlanta announced its plans Tuesday in I papers filed in federal court here and with the Securities and I Exchange Commission. Federal judges in Norfolk have overset I the salvage since 1992. The judges awarded sole salvage rights to R.M.S. Titanic in 1994 but the company has faltered financially in recent years. Its stock plummeted to 15 cents a share this year from a high of S4 in 1995] The decision by R.M.S. Titanic could prompt a race to reach wreckage by other companies. The wreck can be salvaged only during the summer becauser weather in the North Atlantic, where the luxury liner sank in 191 after hitting an iceberg 400 miles off the coast of Newfoundland Canada. Some 1,500 of the 2,000 aboard died in the disastc. The wreck was discovered in 1985 and R.M.S. Titanic began its work two years later. The company conducted six salvageexped tions, the last in 2000, at a cost of $11 million. The companyhas recovered about 6,000 artifacts. A judge recently ruled that R.M.S. Titanic does not ownthearth facts it recovered but is temporary custodian. The companyhas appealed to the U.S. Supreme Court.
