Midland judge orders death penalty DNA test Texas Al DALLAS (AP) — Upcoming DNA tests could cast doubt on the guilt of a man condemned to die in the 1993 strangling of a 7-year-old suburban Dallas girl, The Dallas Morning News reported Saturday in a copyright story on its Website. An independent North Carolina lab conducted a DNA test in January 1998 on a hair found in the vehicle of Michael Blair, now 30, who was convicted of molesting and killing Ashley Estell. Prosecutors alleged at the trial that the hair was the vic tim's. LabCorp said its test proved the hair not to be the girl's. The trial was moved to Midland because of publicity in the Dallas area. Blair's attorneys are trying to have the con viction overturned. In a story for its Sunday edition. The Dallas Morning News reported that a Midland judge has ordered DNA tests on two other hairs found in Blair's car and said by the pros ecution to belong to Ashley. After its 1998 test, LabCorp said: "Although the DNA activity in this sample fails to meet reporting standards due to its weakness, Ashley Estell... is excluded as a possible contributor of the genetic material in this sample." A forensic expert in Virginia contacted by Collin Coun ty prosecutor Tom O'Connell called the results of the test "inconclusive at best." "For two years, I think it is worth the wait, and the safety of the people is more important than just building a bonfire right away," said Chee-seag Lee, a chemistry graduate student. Kimmy Skekel, a prospective stu dent, said she's satisfied with Bowen's decision. "I know the families are devas tated by the bonfire incident," Skekel said. "I think it's a really good idea that he's waiting to make it safe." However, not all students agree with Bowen's decision. Sara Proffitt, a freshman jour nalism major, said Bowen's deci sion was influenced by outsiders' views of the bonfire tradition. "It's a decision more for the public because they are looking in on us and making their own judg ments," Proffitt said. Christopher Lafield, former Moses Hall roommate of John Comstock and a sophomore mechanical engineering major, said he was upset about Bowen's decision. "They took away what brought A&M together," Lafield said. "I can understand that tliey would be apprehensive, but bonfire should continue — just with supervision." Lafield said Comstock told him Bowen's decision over the phone Thursday. "He (Comstock) feels pretty much the way I do," Lafield said.
