Archer has been under tire since say
ing earlier this month that 1 lispanics arc
culturally resistant to the idea that “get
ting pregnant is a bad thing.”
“If I were to go to a Hispanic com
munity and say. ‘Well, v\c need to get
you into family planning,’ they say,
‘No, I want to be pregnant.’ ’’ he told
The New York Times.
Archer issued a written apology and
followed up with an in-person apology
to state lawmakers.
But on Wednesday, the Texas f ree
dom Network, League of United Latin
American Citizens, Mexican-American
Legal Defense & 1 ducational Fund and
Rainbow Coalition said apologies
weren’t enough.

ance of racism
and sexism,”
said Samantha
Smoot, direc
tor of the
Texas Free
dom Network.
“These
questions will
persist until
Commissioner
Archer re
signs.” said
Smoot, whose
group was
founded in
1995 to
counter the po
litical power of religious conservatives.
Archer “has no plans to resign.” said
his spokesperson. Doug McBride.
“Again, he regrets the wrong im
pressions. He’s apologized. He’s look
ing forward to w orking with all Texans
to address the public health issues of all
Texans,” McBride said.
Bush spokesperson Mike Jones said
the governor is satisfied with Archer's
apology and w ouldn’t seek his resignation.
“Dr. Archer has explained and
apologized for his awkward and inar
ticulate language and explained his
true positions. Teen pregnancy is a se
rious problem in every segment in so
ciety and that’s why the governor has
addressed it as a priority in Texas,”
Jones said. “Governor Bush does not
tolerate racism in any form.”

mates, some wielding garden tools,
that left one inmate dead and live oth
ers in intensive care.
The Tuesday night melee at the min
imum- to medium-security Smith Unit
left a total of 31 prisoners injured. The
prison about 60 miles south of Lubbock
remained under lockdown Wednesday.
“We believe it was very racially moti
vated,” viid Larry Todd, a Texas depart
ment of Criminal Justice spokesperson.
Another prison spokesperson, Lar
ry Fitzgerald, said the riot appeared to
center in the prison's recreation >ard
hut evolved out of a fight involving two
inmates in a dining hall.
It was there that a Hispanic inmate
confronted a black inmate who was
fondling himself in front of a female
officer, Fitzgerald said. Word of the
confrontation then spread.

TYLER (AP) — An East Texas
man sentenced to 16 years in
prison for swiping a $1 candy bar
will get a new day in court after a
judge found evidence of jury mis
conduct during his trial.
Visiting Judge Gene Ater ruled
Tuesday that Kenneth Payne III de
serves a new trial after two jurors
admitted that Payne's failure to tes
tify in his case was considered dur
ing deliberations.
The two also said a fellow juror,
a former corrections officer, told ju
rors that Payne would still get out
within four or five years, even if
they gave him a 16-year sentence.
Judge Ater set Payne's bond at
$3,000 and scheduled a new trial
