sands of Internet users sending
online holiday greetings laden
with graphics and audio clogged
AT&T WorldNet’s computer
servers, creating a slowdown in e-
mail delivery for two days.
About 100,000 users of one
of the nation’s largest Internet
service providers were faced
with a 45-minute delay in de
livery of incoming and outgoing
e-mail Wednesday, said Janet
Stone, spokeswoman for AT&T
Worldnet.
The problem lingered with
shorter delays Thursday.
“What has happened, and we
saw this last year, was around
the holidays, people send Christ
mas cards, holiday cards and
scan photos to send to their fam
ily and friends around the Net,”
Stone said.
The multimedia makes the
messages much larger than regu
lar text e-mail. No messages were
lost during the slowdown
Wednesday, she said. Just under
10 percent of the company’s 1.3
million users were affected and
the problem was not geographi
cally based, Stone said.

last year, but it wasn’t enough.

AUSTIN (AP) — A black man who says he was
repeatedly frustrated in his attempts to get work as
a mall Santa has filed a lawsuit claiming racial dis
crimination and breach of contract.
DeWayne Lofton, 32, said he applied for a $7.50-
an-hour job as Santa Claus in November with San
ta Plus, a St. Peters, Mo.-based company that con
tracts with local shopping malls to fill Santa
positions.
Lofton said he was told by Santa Plus managers
they needed approval from mall management to
hire him and that the mall had a policy against hir
ing minorities to be Santas.
Lofton said he contacted mall officials and was
assured the mall did not have such a policy, but his
repeated attempts to start working were stalled and
he eventually gave up.
He filed the lawsuit in state district court Tues
day.
Lofton said when he first talked to Santa Plus in
November, he was told they were desperate for San
ta applicants.
But Lofton said that when he arrived to fill out
the application, a Santa Plus manager told him,
“When I spoke to you over the phone, I did not re
alize that you were black. I’ll have to check with the
mall to see if it would be O.K. to hire, you know.”
Mall manager Nancy Hedrick said Thursday she
did not speak with Lofton and that the mall does not
have a policy against hiring minorities to play Santa.
The lawsuit said Lofton spoke with a man in the
mall management offices but Hedrick said she did
n’t know who that would be. The lawsuit does not
name who Lofton spoke with in mall management
or at Santa Plus.
Lofton and his attorney, John W. Thomas, of
Austin, declined to comment Thursday. A Santa
Plus spokeswoman said she had not seen the law
suit and could not comment.
“We don’t have the authority or responsibility
for employment in tenant spaces,” Ms. Hedrick
said. “We can’t tell them who to hire or not hire.
I’m sorry if this man believes we do, but we don’t,”
Hedrick said.
Hedrick said she has seen a black Sahta in the
mall this shopping season and was told a Hispanic
Santa also is working there.
