JASPER (AP) — Lawyers from
the state Attorney General's
office arrived in Jasper on
Tuesday to help local prosecu
tors prepare a capital case
against at least two of the three
men charged with dragging
another man to death alongside
a country road.
The state attorneys also will
help Jasper officials prepare for a
scheduled Saturday rally by visit
ing Ku Klux Klan members, who
authorities fear could attract
counterprotests from the New
Black Panther Party or other anti-
Klan groups.
The victim, James Byrd Jr., was
African-American. The three sus
pects are white, and authorities
have identified two of them as
having white-supremacist ties.
"Basically what we're doing is
expressing our desire on the part
of everyone here for any hate
groups or groups interested in
stirring up trouble to stay away,"
Jasper County juage joe Folk
said. "And we're encouraging
(Jasper residents) not to attend
the rallies."
Authorities said precautions
will be taken to ensure the safety
of Klansmen, protesters and citi
zens without impeding anyone's
First Amendment rights.
"If they have any questions on
how to deal with (the rally), we'll
certainly address those ques
tions," Ward Tisdale, spokesper
son for Attorney General Dan
Morales, said.

TYLER (AP) — A woman has
received an automatic life sentence
following her capital murder con
viction in the 1997 shooting of a
21-year-old Tyler man.
A jury deliberated about three
hours Monday before finding
Elaine Hays, 26, a high school
dropout from Red Springs, guilty of
robbing, kidnapping and killing
Donald Whittington III.
She must serve at least 40 years
in prison before she will be eligible
for parole.
Assistant District Attorney Sonny
McAfee said Hays planned for more
than a year to rob Whittington
because she knew he received
$15,000 on his 21st birthday from
a trust fund.
Whittington received money
from his 18th birthday to the day
he turned 21 because of a civil suit
involving a childhood injury.
A 19-year-old man, Justin Fuller,
was convicted in March of capital
murder and sentenced to death in
the same killing.
Defense attorney Lajaunda Lacy
said her client was used by her on-

Wideman who, she said, planned
the robbery with Fuller and anoth

Wideman is to stand trial later

Evidence showed he was bound

Sandy Beach at Lake Tyler where
his body was found days later.
On the night he was killed,
McAfee said, Hays encouraged her
co-defendants to get Whittington's
automatic teller machine card and
his personal identification number.
