Attorney General Dan Morales has expressed opti mism that the Supreme Court will agree to hear the case “and give guidance to Texas and the nation on this important issue.” In the decision being ap pealed by the state, a three- judge panel of the 5th U.S. Cir cuit Court of Appeals in New Orleans last month struck down the University of Texas law school’s admissions policy. Ruling on a lawsuit filed by four white law school appli cants, the court said UT had failed to justify favoring some racial groups. In the wake of that ruling, higher education officials at a number of universities had stopped using race as a factor in admissions and awarding of financial aid. Texas then asked for a stay of the ruling’s effect, which the 5th Circuit granted. The stay paved the way for universities to resume, at least temporarily, taking race into consideration in their deci sions, officials said. The Uni versity of Texas and Texas A&M immediately said institu tions would do so. After the state files its ap peal, the stay will remain until the court decides whether to consider the case, according to Morales spokesman Ron Dusek. If the high court decides to hear the case, the stay will con tinue until the case is decided, Dusek has said. If the court does not hear the case, the stay would be dissolved.
