Judge threatened with contempt cm refusal to honor delay in proceedin □ A San Antonio judge faces a possibility of fines and imprisonment after refraining to halt a family violence case. DALLAS (AP) — The threat of a contempt citation is hovering over a San Antonio judge who has challenged the ability of lawyer- legislators to delay court proceed ings during legislative sessions. Bexar County Court-at-Law Judge Bonnie Reed did not halt a family violence case after state Rep. John A. Longoria, repre senting a defendant before her, sought a legislative continuance. Now, contempt ch’arges against Reed are periding be fore the Texas Fourth Court of Appeals in a legal imbroglio that has defense attorneys and legal experts scratching their heads. Such an issue has never come up before. “I felt I was acting within my responsibilities as a judge,” said Reed. “I was just trying to move my docket.” The judge, who maintained the family case even after Longoria obtained two separate orders from the appeals court telling her to delay the proceedings, could become the state’s first sitting judge to be found in contempt. “I’ve made a thorough search of 150 years of Texas case law, and I’ve found no case like this at "I felt I was acting within my re sponsibilities as a judge." —Judge Bonnie Reed all/’ Kevin Warburton, an attor ney for Reed said. . . “I’ve found no precedent that any sitting judge has ever been held in contempt by a higher court,” he said. The Texas Constitution al lows lawyer-legislators to tem porarily delay trial proceedings 30 days before or after the Leg islature is in session. A retired chief justice o! Fourth Court said he had heard of a problem with thel islative continuance. “Mainly because througi my career, if the higher court a lower court to stop, theyali stopped,” said Judge Carlos Ca | na, who retired from the apt late bench five years ago. If the appeals courtfii Reed in «■ tempt, shec: & be fined StT and spend: days in jail. The Tt ’ Supreme Ct ' has named tired Jus: John E. Onion as special mat A ruling is pending after at ing was held March 17. Reed said she believed the ture of John M. Ojeda’s trial served prompt justice. “I’ve had two homicides ' one suicide in family violence es before my court, so I did want it on my conscience if case was delayed,” she said.
