DILLEY,(AP) — A state in mate claims prison guards or dered him to catch and kill hun dreds of rattlesnakes using onlj his hands and a hoe. The prisoner, Tim Volk, who is serving 12 years for armed rob bery, said he got bitten by oneo[ the snakes, which led to his beinj passed over for early release. Now Volk is suing prison ficials in federal court in San Antonio. Volk was quoted as saying in Monday’s San Antonio Express News that he caught and killed rattlesnakes during his twi stints as a field trusty between 1992 and 1994. “At first, you don’t mind. It's kind of a novelty, but it got very tiring very quick,” said Volk, 35. He said he killed the snakes and turned over the valuable hides to the guards. Volk said he complained, but to no avail. In a civil rights lawsuit filed last month, Volk claims he was bitten on Sept. 14, 1994, when guard Robert McHazlett told him to remove a small snake from the work area. Volk said he saw two inmates in the hoe squad fighting. As he tried to toss the rattlesnake away, “a single fang caught me on the finger,” he said. He was taken to a Pearsall hospital, then was airlifted to University Hospital in San Antonio. Back at prison, Volk said he was soon written up for three major infractions: possession of narcotics, violation of safety rules and disobeying an orderin handling the snake. Volk lost on all three counts. He said the write-ups kept him from getting early release and cost him another year in prison.
