BROWNSVILLE, (AP) —
Jose Lopez Hernandez was
jailed not for committing a
crime, but for witnessing one.
The 18-year-old undocument
ed immigrant from Mexico is
considered a key witness in two
U.S. Border Patrol agents’ de
fense against charges of beating
up a one-footed Mexican man-
But Lopez’s attorney says it’s
wrong to jail a witness simply
out of fear that he may not show
up to testify at trial —- regard
less of his immigration status.
"All he wants to do is go
home,” said John Wescoat San
dlin, a Harlingen immigration
attorney who took Lopez’s case'
for free.
The legal controversy involves
patrol agents David R. Gonzalez
and Manny Figueroa. They are
charged in state court in
Brownsville with beating an ille
gal immigrant named David
Bergman, throwing away his
crutches, and then telling him to
swim back across the Rio Grande
to Mexico on March 16, 1994.
Figueroa’s defense attorney,
Ernesto Gamez Jr., said Lopez’s
testimony can damage the credi
bility of Bergman’s claims.
Gamez, who portrays
Bergman as a "border bandit”
who robs illegal immigrants as
they cross the river, said that
Lopez will testify that he was
one of Bergman’s victims in Jan
uary 1994.
Bergman denies taking part
in robberies.
The Border Patrol picked up
I-opez as an illegal immigrant in
November and detained him at
the U.S. Immigration and Natu
ralization Service’s detention cen
ter near Bayview. Sandlin said
the normal procedure for an ille
gal border Grosser from Mexico
would have been a quick deporta
tion, not a prolonged detention.
Last month, Gamez obtained
an order from state District
Judge Robert Garza that Lopez
remain under detention to se
cure his testimony.
Lopez was transferred to the
Cameron County Jail last week
to await Figueroa’s trial, sched
uled for Jan. 30, and Gonzalez’s
trial, expected next month.
Gamez said the detention
was necessary because he has
no power to subpoena a witness
in Mexico.
But when attorney Sandlin
asked for a hearing to explore
the issue Monday, Gamez
agreed to take a videotaped de
position from the witness.
Gamez withdrew his request for
detention after the three-hour
deposition Tuesday, and Lopez
was released from jail.
“This whole thing could have
been avoided if they had de
posed him in the first place,”
Sandlin said. “I think it’s a re
grettable approach, and I think
that if they had thought about
it, they wouldn’t have done it.”
In June 1993, Bergman’s foot
was caught and severed between
a train and railroad tracks as he
fled immigration authorities, ac
cording to news accounts.
Agents Gonzalez and
Figueroa are charged with injur
ing an invalid. Figueroa faces an
additional count of failing to
stop Gonzalez from striking
Bergman. The agents have
pleaded innocent.
Gamez said he wants Lopez’s
testimony in an attempt to
throw out the indictment. He ar
gues that Bergman does not fit
the state’s legal definition for an
invalid because he can support
himself by robbing people.
Teen cable
show focuses
on positives
CORPUS CHRISTI, (AP) -
Tired of bad news about teen
agers? Then check out a new
cable access program focusing
on the positive things teen
agers do in the Corpus Christi
community.
The monthly 30-minute pro
gram called "Teen Scene” is
aired on a public access sta
tion. The first show was broad
cast Friday and will be re
broadcast throughout the
month in vacant time slots un
til a new show is aired Feb. 10.
“In this area, there aren’t
any television programs that
just focus on teen life,” said
District Judge Jack Hunter,
who helped launch the show.
"Young folks don’t watch
the local newscasts, and
there is nothing for them. I
am hoping that real events
like current events, sporting
events, human interest sto
ries and school events can
generate interest.”
Hunter, who heads the
Youth Crime Prevention Task
Force, came up with the show
after seeing a similar pro
gram in the San Antonio area.
Ruben Ramirez, a senior at
Corpus Christi Moody High
School and a program orga
nizer, said he’s already
learned a lot about his peers’
impact on the community.
"I never realized that
teen-agers do so many
things,” he said.
The first health segment
was about the common cold,
although Ramirez promises to
tackle. bigger issues such as
teen pregnancy and AIDS.
