Third S.A. woman
files harrassment
suit against Hooters
The Associated Press
SAN ANTONIO - A third San
Antonio woman has filed a lawsuit al
leging sexual harassment against the
Hooters Restaurant chain.
Deborah Hays seeks unspecified
damages.
In a state district court filing Mon
day, Hays, 27, alleges that Hooters,
among other things, imposed working
conditions that treated women differ
ently than men.
She said Hooters allowed its male
employees to work fully clothed, but
required female employees to wear
"sexually provocative clothing."
Hays applied for and began work
as a waitress at the chain's Rivercenter
Mall location in March 1992. She and
other officials could not be reached
Wednesday night.
In January, two other San Antonio
residents Melissa Tomasini and
Catherine Wood filed similar suits
against the company, becoming two
more in a series of plaintiffs who have
sought legal redress in the last year.
Empire State Building to accommodate
disabled with plans for renovations
The Associated Press
NEW YORK — On a clear day from the 102nd
floor of the Empire State Building, the disabled
also will be able to see forever.
The Justice Department said Thursday it had
reached a settlement with the management of the
art deco skyscraper for roof-to-curb renovations
that will make it accessible to people in wheel
chairs.
Disabled in Action, a New York advocacy
group, filed a complaint with the Justice Depart
ment demanding the changes on Jan. 27, 1992, the
day after the Americans with Disabilities Act went
into effect.
"When 1 was younger, we just assumed that
things were the way they were, and all we could
do was struggle on our own," said Frieda Zames,
vice president of the group. "But when it came to
things like accessibility, we finally realized that
these are man-made situations that can be
changed."
On the 102nd floor observation deck, where
windows could not be lowered, the building's
owner will install periscopes for people in wheel
chairs. The scopes are shaped like the Empire
State Building with a handle in the shape of King
Kong, the giant ape who climbed the building in
the famous movie named after him.
Currently, there are stairs from the elevator up
to the 86th-floor indoor observation area, then
more stairs down to the outdoor area and there
strooms. When the renovation is completed, then
will be a flat path outside, and ramps for there
strooms.
The renovations should be done by Novemh?
said John Wodatch, chief of the public access set
tion of the Justice Department's civil rights divi
sion.
Work on the 86th floor has begun, and the out
door observation deck is temporarily closed«
workers can carve new, lower winefows intht
parapets for people in wheelchairs.
Other renovations will include curb cuts ontl*
Fifth Avenue sidewalks and an automatic dooril
that entrance. Drinking fountains, elevator pare
els, telephones and tourist ticket counters will b
lowered, and Braille instructions will be installed.
The work will cost $1.8 million and is pari of
$40 million capital improvement project, saidJre
Carella, a spokesman for the building's managal
Helmsley-Spear.
Cary LaCheen, an attorney with New Yoi,
Lawyers for the Public Interest, which filed' 1
complaint on behalf of Disabled in Action, sal
she was happy with the settlement.
"But we're unhappy that it's taken solonganl
that the Empire State Building didn't do there
things on its own years ago," she said.
Wodatch said it took a couple of years to read
a settlement "because we were dealing with a his
toric building and they had to get approvals front
the Landmark Commission.”
