Supreme Court
refuses to rule
on judge's smile

HOUSTON - The U.S.
Supreme Court on Monday re
fused to hear an appeal of Texas
death row inmate Robert Drew,
who was challenging a Houston
judge's signature that included a
"happy face" on his execution
warrant.
Drew's attorney, Ronald
Kuby, of New York, said while
the high court would not hear the
case, no court has ruled yet on
the constitutionality of District
Judge Charles Hearn using the
smiling face as part of his signa
ture.
The matter went to the
Supreme Court after lower courts
also rejected Kuby's complaint.
"It was dismissed on techni
cality, that he could have raised
this issue before when his 1988
death warrant was signed this
way," Kuby said. "Our answer to
that was simply, that's an insane
rule. This is a fresh proceeding.
The constitutional violation is
fresh."
Hearn last year used the hap
py face with his signature on a
warrant setting a lethal injection
date for Drew, who is now on
death row for the fatal stabbing
of an Alabama teen-ager in 1983.
The judge insisted he meant
no malice with the embellish
ment, which he said he had used
for years and is meant as a sym
bol of his faith in God.
Hearn on Monday was in
volved in picking a jury for a trial
and did not immediately return a
telephone call.

Bryan said there recently has
been a change in stalking and
harassment laws in Texas.
Stalking cases usually are
characterized as harassment. On
the first occasion the person is
charged with a Class 13 misde
meanor. The case becomes a
Class A misdemeanor when the
harassment occurs on more than |
one occasion.
Stalking brings a charge of
third degree felony only when
the victim is actually assaulted.
Andreski, who is in chargeof
Dalton's case, said several I
charges are pending against Dal
ton's stalker.
Andreski said the man will be
charged with attempted sexual
assault and stalking if he is
caught.
Dalton said people tend to
think situations invrilving stalk
ing could never happen to them.
"When people come into
