SEC
Continued from Page 1
that fraudulently gained money
was used toward the $200,000 do
nation to Texas A&M's chemistry
department.
The SEC says the investors
were sold limited partnerships in
a foreign currency exchange pro
gram, promised returns of 25 to
41 percent and told the ventures
were risk-free.
The case was filed in a federal
court in Los Angeles this past
March.
Michael Hall, head of the Texas
A&M chemistry department, said
Telander's $200,000 was accepted
by Ken Durham, then vice-presi
dent and director of development
for Texas A&M's Development
Foundation.
Durham has since retired.
When contacted at his College
Station home, Durham said he
knew that the money was ear
marked to support the research of
John Bockris, a Texas A&M distin-
uished professor of chemistry,
ut not that the project involved
attempts to turn mercury into
gold.
Texas A&M's Development
Foundation was asked in the fall
of 1992 to turn over records about
the gift as part of a federal in
quiry, said Liska Lusk, general
counsel for the foundation.
Hall said he was notified by
the SEC about the Telander inves
tigation last May. At that time, he
said, about 75 percent of the mot
ey had been spent. The chemist!
department has since frozen tl’
remaining money, which is ir
Texas A&M Development Foil!
dation account.
"We've never gotten an officii
notice from the SEC that Wi
should do anything else with #
money," Hall said. "Should tli'
SEC decide if it's been obtained
improperly, then we would wait
to keep it here for the investor!
This in fact may be Mr. Telander 1
own money."
SEC officials said some oftlii
investment money was usecL
buy a house for Telander's girl
friend in Napa Valley and tore! 1
Lear jets.
Eddie Joe Davis, the presided
of the A&M Development Foua
dation, said the foundation^
"fully complying" with the SEC
"We have to be cooperati' 1 *
and forthright with the commis
sion and that's what we're do
ing," Davis said.
He said the foundation
shouldn't be faulted for accepts
the money.
"One thing that we do is tak*
contributions from a wide variet'
of individuals, corporations arro
foundations," Davis said. "W
must rely on their good faith a0 i
integrity. If they're kind enougl
to provide us with contribution!
we don't run them through an ir 1 '
vestigation."
Michael Perlis, Telander*
lawyer in Los Angeles, said hi*
