AUSTIN — A woman who was secretly
videotaped having sex with her former
boyfriend has reached a settlement with the
man, her attorneys said Tuesday.
Susan Kerr, who claimed she suffered se
vere mental anguish after Dan Boyles Jr.
showed the video to other people, said, "l
am glad that the case was brought to a suc
cessful conclusion and was glad that the or
deal is over."
Details of the settlement were not disclosed,
but Kerr's attorneys, Ronald Krist, Richard
Morrison, and Kenneth Burch, said it "approx
imately totals" the original $1 million award
for her.
Boyles' attorney Barry Chasnoff could not
be immediately reached for comment by The
Associated Press.
On Aug. 10, 1985, Boyles, then 17, allowed
three friends to videotape himself and Kerr,
then 19, having sexual intercourse at the Hous
ton home of one of the men.
Boyles played the video three times for a to
tal of 10 people, according to court records.
Gossip about the video spread around the
University of Texas, which Boyles attended,
and Southwest Texas State University, where
she was a student, Kerr said.
She sought psychological help because of
humiliation and embarrassment from the inci
dent, court records said.
In 1989, a Harris County jury ordered
Boyles to pay Kerr $850,000, and the remain
ing three defendants, $150,000.
But last year, the Texas Supreme Court re
versed the decision, and remanded the case for
a new trial.
The state Supreme Court ruled that Texas
law does not allow people to sue others who
negligently cause them emotional distress.
That was the basis on which Kerr won the
judgment.
In protesting the state Supreme Court's
decision, Kerr's attorneys said the publicity
of a new trial was unfair to her.
On Tuesday, Kerr said in a prepared state
ment released by her attorneys, "My only re
gret is that the Supreme Court's recent deci
sion will make it more difficult in the future
for other victims to seek redress through the
courts."

SAN ANTONIO - San Anto
nio is on the verge of joining
Texas' two other largest cities in
establishing civilian review of its
police department.
But as city leaders and the po
lice union haggle over how
many citizens will be involved,
critics claim both sides are mov
ing too slowly and aren't going
far enough.
"We've come a long way,"
Mayor Nelson Wolff said Tues
day. "This is really going to be a
major, major step."
Taking that step hasn't come
easily in this city where the police
department is still trying to over
come a troubled past and where
this summer three officers have
been accused of wrongdoing in
highly publicized cases.
A citizens committee appoint
ed last year recommended San
Antonio create a civilian review
board to hear police complaints
alongside the current police
board. The three-member citizens
panel would have been selected
from a 12-member pool of civil
ians. It would make recommenda
tions to the police chief, though it
wouldn't investigate on its own.
The City Council — noting po
lice union opposition and the like
lihood of a legal challenge — did
not implement the recommenda
tion last fall, but offered it up for
bargaining with the union.
The San Antonio Police Offi
cers' Association, representing the
approximately 1,550 police offi
cers, doesn't like the idea.
"We don't want it. We ain't
never had it. It ain't going to
work," said union president Jerry
Clancy. "But politically the coun
cil threw it over into our laps. We
have been forced to negotiate."
The union, which initially in
sisted on only one civilian, now
has agreed to letting two citizens
sit in with the current police re
view panel and hear complaints,
Clancy said.

HOUSTON — The Justice Department will investigate possible
criminal civil rights violations by police in several upscale communities
where apparent racial disparity exists in traffic arrests.
The Houston Chronicle reported Tuesday that the criminal section of
the department's civil rights division has asked the FBI to probe allega
tions of unequal treatment of minorities in the six cities.
"This will be to determine whether there have been any incidents
that would violate federal criminal civil rights statutes," said Justice
Department spokesman Myron Marlin.
The local FBI office already has begun contacting local officials as
part of a preliminary probe of the allegations, Marlin said.
Civil rights leaders had demanded a probe of the Memorial Villages
area following a Chronicle investigation that found minorities, particu
larly Hispanics, were arrested routinely last year on minor traffic of
fenses while whites were generally ticketed and allowed to go free for
the same offenses.
The four-month investigation found that minorities received about a
third or less of the traffic tickets in the Villages but made up at least 85
percent of the arrests for minor traffic offenses. Seventy-five percent of
those arrested were Hispanics.
Minority and civil rights leaders praised the federal investigation.

Garth Brooks to
lip-sync during
fourth concert
IRVING (AP) - A fourth con
cert is planned next month by
country superstar Garth Brooks
at Texas Stadium in Irving.
And this one likely will be
free. But don't expect to hear
Brooks sing live.
Brooks is expected to lip-sync
to tapes recorded live during the
first three concerts Sept. 23-25.
Promoter Linda Smith of
Glenn Smith Presents says the
free appearance will be used for
filming closeups and retakes to
be used in an upcoming televi
sion special.
Smith says details on distribu
tion of tickets are being worked
out.
She says about 65,000 tickets
are expected to be given away.

Too early to sell
Koresh's goods,
attorney says
WACO (AP) — An attorney
representing deceased Branch
Davidian guru David K-oresh
says it's too early to begin selling
off such items as the former cult
leader's cherished Camaro car.
Some surviving Branch Da-
vidians are seeking to sell items
accumulated by the religious sect
for money to use for living ex
penses, said attorney Gary Cok
er, who represents the Branch
Davidian Seventh-day Adventist
Association.
But Houston attorney Percy
Isgitt, who represents Koresh, is
fighting the attempt.
"We're still trying to deter
mine who the heirs are," Isgitt
said. "Until we do, it's premature
to sell things."
Both sides were to meet in Dis
trict Judge Bill Loguc's court Tues
day to help settle the dispute, but
a hearing was postponed.
Koresh and more than 80 of
his followers died in a fire April
19 following a 51-day standoff
with authorities.
Isgitt also represents Paul Fat-
ta, who is charged with conspira
cy to murder federal officers and
conspiracy to manufacture and
possess unregistered machine
guns.
He said Fatta owns some of
the property’ in question.
Coker said, "Some of the
property has already been sold
for scrap."
"We're asking the judge's
permission to sell some motor
cycles, cars, tractors and farm
equipment," he said. "The Da-
vidians owe for lodging. They'd
like to get a place to stay and
have some money for living ex
penses. Some of their money
might go to attorneys."
Murderer year's
12th to die by
lethal injection
HUNTSVILLE (AP) - Con
victed murderer Ruben Cantu
quietly went to death early Tues
day for killing a man during a
burglary and robbery nearly nine
years ago in San Antonio.
Cantu, 26, had no final state
ment anef Tittle reaction to the
lethal drugs that flowed through
his heavily tattooed arms.
The execution was the fifth in
Texas in five weeks and the 12th
in the state this year, equalling
the record number of lethal injec
tions carried out in Texas all of
last year.
State attorneys believe at least
five of the 14 inmates now with
execution dates are likely to be
put to death in the next two
months, including Richard Wilk-
erson, scheduled to die next
week for a bloody rampage that
left four people dead at a Hous
ton amusement park in 1983.
Cantu's only words as he was
strapped to the death chamber
gurney was a nervous "No sir"
when he was asked by Warden
Jack Pursley if he had a final
statement.
