said Michelle Campbell, election
co-commissioner.
"The problem is not because it
was brought to the polling places;
that's just how we were made
aware of the situation," Campbell
said. "How it was distributed is
why they were fined."
Campbell said Haraway con
firmed with her the flyers were
distributed during an illegal cam
paigning time.
The fines, which are added to
each candidates total election ex
penditures, could disqualify the
cadets if the total expenditure is
more than the spending limits set
by election regulations.
Michelle Cook, election co
commissioner, said all candidates
were clearly informed of the regu
lations, and the possibility they
might be fined.
"At the very first, we let the
candidates know the rules on how
much you can spend campaign
ing," Cook said. "We said to note
that you might want to give your
self a little leeway so you won't go
over (if fined)."
According to Election Regula
tions, any candidate exceeding
campaign spending limits will be
disqualified.
In the Election Commission's
final decision, Cook and Campbell
said the memorandum cited four
articles of the Election Regulations
considered in the final ruling:
•Door-to-door campaigning
during hours which members of
the opposite sex could not
•The candidate is held solely
responsible for the actions taken
by his or her supporters
•A candidate caught illegally
distributing campaign literature
will be fined $25
•Election Commission is the
sole judge of what is formal cam
paigning and has the authority to
take whatever action deemed nec
essary.
Cook said she could not specu
late on how many cadets may be
affected -by the fine because the
election wiygrers have until April
9 to turn in expense reports.
Beller said cadets affected by
the ruling are free to file an appeal
with the Student Government Ju
dicial Board.
"If the candidates don't agree,
then I encourage them to appeal,”
Beller said. "The intention here is
fairness."

the list for illegal distribution of
the flyer. The fine is considered a
part of campaign expenditures.
If the fine pushes race-winning
cadets over campaign spending
limits, they are disqualified and
must forfeit their newly elected
positions.
Election winners are not re
quired to turn in expense reports
until April 9.
Adolfo Garcia, deputy Corps
commander, said it is not fair to
fine all 26 cadets for the actions
which they had nothing to do
with.
"How can you fine a person
who doesn't understand why they
are fined," Garcia said. "This was
not campaign literature."
Billy Dean said the fines were
nothing but an attack against the
Corps.
"This seems to be picking on
the Corps just for being the
Corps," he said. "We get out and
vote and people don't like it.
Everyone from the Commandant's
office down is just appalled by
this."
Steve Beller, student body pres
ident denied the fines were an at
tack on the Corps.
"We are not attacking the
Corps by any means," Beller said.
"There are election regulations
everyone has to follow. When
they decide to take part, they de
cide to follow the rules."
Campbell said Haraway con
firmed the flyers were distributed
door-to-door during illegal times,
but Billy Dean said that is inaccu
rate.
"They accused us of violating
times of distribution, but they
were distributed in the University
mail system which everyone has
access to," he said.
Corps staff feels like they are
being told by Student Govern
ment how to run their organiza
tion, Billy Dean said.
"This is not a matter of whether
or not this was campaigning, it's a
matter of whether or not we as the
Corps can communicate with our
cadets," he said.
Beller said the Election Com
mission became involved because
the actions of the Corps were af
fecting students outside of the or
ganization.
"The Corps can do whatever
they want, but when their actions
start to affect the election process,
that is when the Election Commis
sion needs to act," Beller said.

tance of multiculturalism.
Of the other three candidates
who did not make the run-off,
Jimmy Stathatos received 9 per
cent of the vote, Jason Arbaugh
11 percent and Zack Barcevac 6
percent.
