Bill orders release of JFK info
THE ASSOCIATED PRESS
WASHINGTON - President
Bush signed a bill Tuesday requir
ing government agencies — in
cluding the FBI and CIA — to re
lease secret material on the assas
sination of President Kennedy.
Amid a furious campaign
schedule, Bush penned the so-
called JFK bill into law in Paduc
ah, Ky.
"I sign this bill in the hope that
it will assist in healing the
wounds inflicted on our nation al
most three decades ago," Bush
said in a statement issued follow
ing the signing. Bush expressed
concerns that the law may erode
his constitutional authority to
control executive branch secrets.
But he said, "I fully support the
goals of this legislation."
The law sets down the guide
lines for Congress, executive
branch agencies, and government
research centers such as the Na
tional Archives and presidential
libraries, to release a mountain of
still-classified material on the
Nov. 22, 1963, assassination. The
material includes everything from
top secret intelligence reports to
news clippings and tax returns.
Documents that agencies re
fused to release would be re
viewed by a five-member com
mission appointed by the presi
dent. The commission would
have the power to make public
the disputed materials. In the case
of executive branch documents,
the president could overrule the
commission and withhold docu
ments but only by showing that
"grave harm" would result by
their release.
One exception written into the
law is the file of photos and X-
rays taken during the autopsy of
Kennedy. The material would re
main confidential and access
would be controlled by the
Kennedy family.
Bush complained that the law
lacks specific language allowing
him to withhold documents from
public view if they concern execu
tive branch deliberations and law
enforcement methods. The nation
al security exceptions were also
too narrowly drafted. Bush said.
Bush set the stage for a possi
ble court battle over presidential
power.
"My authority to protect these
categories of information comes
from the Constitution and cannot
be limited by statute," Bush said.
These concerns reflected objec
tions originally raised by the Jus
tice Department when the bill was
moving through Congress. Be
yond the constitutional objections,
though, the Bush administration
had reason to strongly support
the bill.
CIA Director Robert Gates, tes
tifying before Congress earlier
this year, said he was ordering the
rapid review and release of relat
ed material in the hopes of clear
ing his agency of suspicion.
Gates, who heads an agency
once led by Bush, said the allega
tions of CIA involvement in the
Kennedy assassination were un
founded but nevertheless damag
ing to the agency's reputation.
