Justice defers jail inmate bill
HOUSTON (AP) — Supreme Court Justice An
tonin Scalia on Wednesday stayed a federal
judge's ruling that would have allowed Harris
County to bill the state of Texas when it had to
house excess jail inmates in other Texas lockups.
Last month. Chief U.S. District Judge James
DeAnda ordered the state of Texas to come up
With $750,000 by Wednesday that could be used
oy Harris County to rent jail beds in other coun
ties.
But Scalia temporarily set aside the order re
quiring the state to set up the fund. The stay will
remain in effect at least until March 27 to give Sca
lia time to review the case.
In the Feb. 7 ruling, DeAnda ordered the
county to reduce its jail population to 6,300 or
move excess prisoners to other lockups and send
the state the bill.
Harris County Sheriff Johnny Klevenhagen has
argued the county could stay well under the
court-mandated population limit if the state
would just take all or the prisoners that have been
sentenced to prison.
But the state is under its own court order to
limit its prison population. To comply with that
order, corrections officials have set up a quota
system in which only a certain number of prison
ers are accepted each week from county jails in
Texas.
On any given day, about 2,000 inmates in the
Harris County jail are supposed to be in Texas
prisons. The court-ordered cap calls for a limit of
4,725 county prisoners and 1,575 state prisoners.
Klevenhagen said there were 2,775 state prison
ers — 1,200 above DeAnda's limit — in the jail
Wednesday. In contrast, the county was more
than 100 inmates underneath its cap with 4,577 in
mates in the jail.
"It's just another one of their stalling tech
niques," Klevenhagen said in response to the re
prieve the state won Wednesday. "They realize
that every day they put it off, they've saved
$48,000, because that's what it would cost to
house 1,200 inmates that are in excess of what the
federal judge ruled.
"They're (the state) unwilling to handle their
•own problem," he said.
"And it means that we're overcrowded," Kle
venhagen said. The sheriff had lined up 1,800
beds in other county jails, and he said Harris
County was ready to begin moving prisoners to
those facilities in a week.
But the Texas Attorney General's Office, which
had appealed DeAnda's ruling to the Supreme
Court, was encouraged by Wednesday's ruling.
"This means that $750,000 of state taxpayer
money will not be going into an account ded
icated for the Harris County jail system," said
Gray McBride, spokesman for Attorney General
Dan Morales.

HOUSTON (AP) — Local
black ministers asked the district
attorney Wednesday to tempo
rarily ban the movie "New Jack
City" until Warner Bros, re
searches the effect the film about
drug dealers is having on urban
black youth.
"We want (film director) Mario
Van Peebles to make millions of
dollars," the Rev. James Dixon
said at a Harris County Court
house news conference. "But
he's not there to counsel the
drug addicts that we counsel.
He's not there to counsel the
woman whose children have
died."
Dixon and three other min
isters who comprise the Urban
Crisis Task Force said the federal
Anti-Drug Abuse Act of 1988 en
courages private industry to be
involved in anti-drug efforts.
He said Warner Bros., which
produced the movie, should de
termine the movie's effect on
youth before it continues to
show it. The ministers also want
the Harris County district attor
ney's office to enforce the mov
ie's 'R' rating, barring children
under 17 from entering the the
ater without an adult.
"We are not even alluding to
censorship," Dixon said. "But
the government has asked all in
dustries to cooperate in the na
tional war against drugs."
Houston-based energy company offers
board position to Gulf War celebrity
HOUSTON (AP) — Lt. Gen.
Thomas W. Kelly may parlay the
fame he garnered during the
Persian Gulf War into a board
position with Houston-based en
ergy company, Enron Corp.
Kelly, who had jousted daily
with reporters during televised
war briefings, announced March
4 that he planned to retire from
the Army at the end of the
month. But he had no immediate
plans.
Enron Senior Vice President
Ed Segner said Tuesday the
Houston company had offered
Kelly a possible seat on the
board. But Kelly, 59, can't for
mally accept the offer until he re
tires, Segner said.
