IV.,. zatficz DALLAS (AP) — The perjury in dictment that cost former police chief Mack Vines his job was thrown out Tuesday by a visiting judge. Former Texas Court of Criminal Appeals Judge John Onion quashed the misdemeanor perjury indict ment during a hearing, a court spokeswoman said. The defense had sought to quash the indictment, “alleging that it left out some necessary language,” Assis tant District Attorney Ted Steinke said. Steinke said the DA’s office was drafting a new indictment that would be filed Wednesday. Onion’s ruling was not a setback for the prosecution, Steinke said. “This happens every day in the courthouse. It’s not an unusual at all,” he said. Vines could not immediately be reached for comment. Vines’ spokeswoman, Lisa LeMaster, had no immediate comment. Bill Boyd, Vines’ attorney, said he was pleased with the judge’s ruling. “I would hope that that would be the end of the matter,” Boyd said, “but it’s up to the district attorney. “I would hope that they would have better things to do with their time than to fool with this,” he added. “We’ll review the new indictment, if they file, and see if it’s properly done,” he said. “If not we’ll file to quash, again. Bill Clements in the office she will soon make hers. “We had a very good exchange,” Richards said after the 40-minute meeting that was also attended by Clements’ wife, Rita, and staff aides.
