Judge drops
charges against
record store
DALLAS (AP) — A judge on
Thursday dismissed charges against
a record store chain in connection
with sales of a 2 Live Crew rap al
bum that has been ruled obscene.
Dallas County Criminal Court
Judge George Shepherd said eight
misdemeanor charges against Sound
Warehouse Inc. for the sale of the al
bum, “As Nasty as They Wanna Be,”
were dropped at the request of pros
ecutors.
Assistant District Attorney Mike
Sullivan said the county would not
press the case as long as the record
ing, which was deemed obscene by a
federal judge in Florida, was not
sold in Sound Warehouse stores.
“The state claimed it (the dis
missal request) was in the interest of
justice,” said Shepherd. “One of the
wags in the courthouse thought it
was curious that it happened two
days after the election.”
“The state claimed it
(the dismissal
request) was in the
interest of justice.”

Shepherd,
Dallas County
Criminal Court
Assistant District Attorney David
Pickett had announced at a July
news conference that his office
would file charges against Sound
Warehouse for distributing the al
bum, generating statewide news cov
erage.
Pickett lost his bid for a district
court seat in Tuesday’s election.
The rap album’s lyrics, which
prompted protests nationwide, in
clude more than 200 lewd words and
phrases, he said then.
“We agreed to dismiss all the
criminal charges against Sound
Warehouse,” said Sullivan.

Three brothers plead guilty in ‘Jet Set’ drug case
SAN ANTONIO (AP) — Five
meVnbers of alleged drug kingpin
Mario Alberto Salinas Trevino’s
family pleaded guilty to drug and
money laundering charges in the
massive “Jet Set” drug case.
Three of Salinas’ brothers
pleaded guilty Wednesday in federal
court to conspiracy to possess with
intent to distribute more than 1,000
kilograms of marijuana and more
than five kilograms of cocaine.
Baldemar, Jose Manuel and Ho-
racio Salinas Trevino, now could re
ceive up to life in prison. However,
Assistant U.S. Attorney Jack Frels
said as part of a plea bargain he will
recommend they receive 10 to 15
years each.
Also on Wednesday, Serafin Gu
tierrez Pena, Mario Salinas’ brother-
in-law, pleaded guilty to one count
of money laundering. He faces up to
10 years in prison.
Jose E. Salinas Alanis, Mario Sali
nas’ cousin, also pleaded guilty to the
conspiracy count. He could spend
up to life in prison, but Frels recom
mended he receive between 10 and
15 years.
“I expect they pleaded guilty be
cause a jury was standing by, and the
government was prepared to go for
ward,” Frels said. “There were no
longer any delays, or reasons for
continuances, and their fate was im
minent.”
So far 12 of 34 people indicted in
the massive drug case have pleaded
uilty. The case was dubbed “Jet
et” because private jets were used
to move drug money around the
country and into Mexico.
There are 11 fugitives in the case.
Officer accuses commissioner of aiming Uzi at him
DALLAS (AP) — An outspoken
county commissioner, accused of
brandishing an Uzi machine gun at a
police officer, said Thursday the
confrontation escalated when the
off-duty policeman made a racial
slur.
But John Wiley Price denied that
he pointed a weapon at Robert Ber
nal after the officer jogged across his
front lawn. Price and his attorney
made a statement Thursday af
ternoon to police regarding the inci
dent.
“He (Bernal) did more than utter
a racial epithet,” said Price, who is
black. “He invaded my privacy by
jogging across my yard.”
No arrests have been made, al
though Dallas County prosecutors
met with police to discuss the con
frontation, and officers said their in
vestigation could be completed by
Friday.
The commissione claimed that
Bernal cursed him and called him by
a racial epithet as Price was prepar
ing to enter his East Oak Cliff home
on Dallas’ south side Monday af
ternoon.
Bernal crossed his yard, then
yelled an obscenity, Price said in a
telephone interview Thursday.
“He said, ‘You’re a nigger.’ As far
as I was concerned, the chase was
on,” the commissioner said.
Price, who has been criticized for
saying he would issue a “call to arms”
if Dallas’ next police chief was insen
sitive to minority issues, said he
chased Bernal, who was jogging with
another man.
“When I caught up with him, I
said, ‘Hey, you talking to me?”’ Price
said.
Price said he then punched Ber
nal in his chest when Bernal re
sponded, “‘This is freedom of
speech.’ I said, ‘Well free this,’ and
punched him again. Then he said,
‘I’m a police officer.’
“But he never showed me any
badge,” Price added.
But Bernal, in a complaint filed
Tuesday, gave a different version of
the confrontation. He said a man,
not identified in the complaint, ap
proached him and his companion,
18-year-old Omar Gallegos, from
behind, shoved him and pointed an
Uzi machine gun at his head near
Lake Cliff Park.
“That’s not the case,” said Price. “I
did not point any gun at him and I
did not have any Uzi.”
