The Texas Court of Criminal Ap
peals should interpret the law of the
people instead of legislating its phi
losophies according to Judge Oliver
S. Kitzman of the 155th Judicial Dis
trict.
Kitzman, who is running for a po
sition on the Texas Court of Ap
peals, spoke to College Republicans
Tuesday.
Also appearing at the meeting was
J.D. Langley who is campaigning for
judge of the 85th District Court of
Texas.
Kitzman, who is seeking the seat
held by Sam Houston Clinton, said
that in recent years the Court has
been led by the activist majority on
the court.
“These activists are judges who
tend to reach past the law that is
written by the legislature and put
into place the law as they would like
to see it, ” he said.
Kitzman said that when activists
take control, the government’s rights
are suspended and the criminal laws
become unstable.
In an attempt to fix the unstable
ness of the Court, Kitzman would
like to see judicial restraint restored
to a position of strength and dignity
in the court system.
“By restraint, I mean that judges
should follow the law as it’s written
and honor the separation of powers
between the executive and judicial
powers,” he said. “The only thing
that will stop judges (from inserting
their own philosophies when making
court decisions) is their own restraint
and respect for the system.”
Kitzman noted that this year vot
ers have the opportunity to elect five
