HOUSTON (AP) — An arbitrator
assigned to decide whether a former
police officer will get his job back
abruptly ended a hearing on the
matter when the officer’s attorney
tried to discredit the chief who fired
him.
Charles Morris, a Southern Meth
odist University law professor and a
longtime arbitrator, ended the hear
ing Tuesday, but said he did not ex
pect to make a decision on the case
until late November.
Scott Tschirhart, 27, w r as fired
from the department after he killed
an off-duty security guard, Byron
Gillum, during a routine traffic stop
Nov. 15.
Gillum, 24, was shot eight times,
including four shots in the back.
Gillum was the third black man
shot to death by Tschirhart, who is
white, in the 7’/a years he was a
Houston police officer.
Tschirhart was fired in January by
then-Police Chief Lee Brown.
At least two grand juries declined
to indict Tschirhart in the shooting,
prompting him to seek reinstate
ment.
Tschirhart’s attorney, Ed Lasof,
tried to prove Brown, now New
York City ’s police commissioner,
lied during his testimony presented
Saturday.
Brown testified he did not know
the department’s internal affairs di
vision originally did not sustain alle
gations against Tschirhart.
Brown also testified he believed
the shooting was unjustified and did
not follow the department’s regula
tions on the use of deadly force.

Seven roll-away beds, $40.00 each. Golf clubs, stereo,

776-0400. 194ttfn
But Morris ordered Lasof not to
pursue “a wild goose chase” in pre
senting witnesses to contradict
Brown’s claims.
Morris said what went into
Brown’s decision to fire Tschirhart
was irrelevant in whether the former
officer gets his job back.

Lasof disagreed, saying if that
were true, “it was a sham and a farce
to have him here in the first place.”
Morris ordered Lasof and Assis
tant City Attorney Luke Daniel to
file final written arguments by Oct.
22.
Morris would then rule on the
case within 30 days, he said.
