Sheriff’s testimony casts doubt
on claim of self-defense in trial
TYLER (AP) — Loyal Garner Jr. was being held in a
detoxification cell without furniture or anything to use
as a weapon when he was beaten by lawmen in Hemp
hill, a sheriff testified Thursday in the murder trial of
the three former officers.
Sabine County Sheriff Blan Greer said Garner and
his friends, Alton Maxie and Johnnie Maxie, were be
ing kept in an empty cell after being arrested for
drunken driving on Christmas Eve 1987.
Attorneys for the defendants — former Hemphill
Police Chief Thomas Ladner and former Sabine
County sheriffs deputies James “Bo” Hyden and Billy
Ray Horton — say the men beat Garner in self-defense
after he became violent.
The three were acquitted in an earlier trial of violat
ing Garner’s civil rights. Garner was black; the de
fendants are white.
Greer said Garner had no access to weapons in the 8-
by-17 foot detoxification cell.
“There’s nothing in there for them to get a hold of or
pick up, is there?” Jack Skeen, Smith County Distriti
Attorney, asked Greer.
“No, sir,” the sheriff responded.
Greer said he returned to Hemphill from a triptht
night Garner and the Maxie brothers were arrested
But he was not called to the department that night;and
when he arrived about 8:15 the next morriing, an am
bulance had been called for Garner, Greer sain.
Garner was taken to a hospital in Tyler, where ht
died the next day from head injuries he suffered in,tk
beating.
Greer said he called Texas Ranger Roscoe Davis n
investigate the incident since it involved two of his jail
ers.
Also Thursday, the three-man, nine-woman jury was
shown the slapjack Ladner said during the civil rights
trial that he used to hit Garner in the head. Aslapjackis
a foot-long device with a handle and middle spring.

to stand trial
LOCKHART (AP) — A Caldwell
County jury decided a 13-year-old
boy is competent to stand trial for
the March 8 slayings of his parents at
their home
The eight-woman, four-man jury
took about 30 minutes Wednesday
to find the teen-ager fit to help in his
defense and able to understand the
legal proceedings.
Presiding juror Mary Kochran
said the jury gave “a lot of weight” to
the testimony of a court-appointed
psychiatrist who said the youth was
competent.
After two 90-minute sessions with
the youth, Austin psychiatrist David
Cardwell said Tuesday the boy un
derstands his circumstances.
The boy is on trial for the March 8
shootings of his parents.
Caldwell said the youth suffered
from some depression, but said it is
not severe enough to cause halluci
nations.
Earlier testimony by the boy’s
grandmother and his two attorneys
said the boy on one occasion told of
an out-of-body experience the night
of his parents’ death.
Attorney Kyle Maysel testified
Tuesday that the youth said he had
seen himself floating and telling his
other self not to kill his parents.
The youth was mixed up about
some events the night of the shoot
ing, Cardwell said, but in general
was “cohesive and coherent” during
their discussions.
If convicted, the youth could face
a 30-year sentence in Texas Youth
Commission facilities and state
prison.
Officer back on duty
after heart transplant
VICTORIA (AP) — For Eddie
Locke, going back to work as a
policeman was something he was
determined to do. even though
the odds were stacked high
against him
You might say he had his heart
set on it.
Roughly nine months after a
heart transplant, he is working
his way back to full-time duty as a
patrolman.
It’s likely he’ll be the first heart
transplant patient to do that.
Locke fulfilled a large part of
his goal on March 1, when he re
turned as a police officer with the
Victoria Police Department.
The rest should be accom
plished by April 27 when he will
take to the streets foi the first
time in almost four years.
Locke has been in an abbre
viated field officers training pro
gram, becoming reacquainted
with the routine of police work.
He is paired with an active patrol
officer.
Locke, who was 40 on March
27, underwent the transplant July
27, 1989, at Houston’s Methodist
Hospital. He had waited since
May 1988 for the new heart,
which came from a 15-year-old
killed in a motorcycle accident in
Houston.
In May 1984, Locke was diag
nosed as having inflammatory
cardiomyopathy. Four years
later, his heart’s condition had
deteriorated to the point that his
doctors determined a transplani
was necessar v to save his life

year and a hall after his doctors

when Locke was diagnosed as 100
percent disabled, the department
agreed to hold his position open
for his return.
After he had been gone more
than a year Talley asked to have
the budgeted position filled, still
with the understanding that
when Locke was ready ro come
back, he would have a job.
“It is always good to see some
one come out of a situation like
Eddie was in,” Talley said. "We
welcome him back. It is always
good to get a proven member of
the department back. He is a va
lued employee.”
Before he could make his
comeback, Locke’s doctors in
Houston had to sign a release in
dicating there were no restric
tions can his activities.
Since March 1, Locke has been
busy brushing up on departmen
tal changes and new laws.
