Soft drink firm agrees to pay
millions in accident settlement
McALLEN (AP) — A newspaper reported Tuesday
that a soft drink company has agreed to pay $67.5 mil
lion to settle claims in the deaths of 15 students who
died in the state’s worst school bus accident.
The agreement, according to the McAllen Monitor,
involves Valley Coca-Cola Bottling Co. Inc. paying a
structured settlement of $4.5 million to victims’ families
for each death.
A structured settlement would guarantee families
monthly payments of thousands of dollars for the rest
of their lives.
One lawyer the Monitor did not identify was quoted
as saying, “We have an agreement in principle. It’s just
a matter of taking this before a court for approval and I
don’t see a problem with that.”
McAllen lawyer Morris Atlas, who was brought in to
assist the negotiations, declined to comment on reports
of a settlement, the newspaper reported Tuesday. Atlas
did not return phone calls Tuesday to the Associated
Press.
“There’s not anything I can talk about relating to any
negotiations,” Ramon Garcia, an Edinburg attorney
who represents the families of three students who died
and several of the injured, told the AP.
“We have been negotiating for some time now,"Gar
cia said.
Lawyer David Hockema, whose McAllen-based firm,
Flores, Munoz, Hockema 8c Reed, represents several
victims’ families, told the Monitor he could not discuss
ongoing negotiations.
I he accident occurred Sept. 21, 1989, in the South
Texas town of Alton. Twenty-one students died and an
other 60 were injured when a truck owned by Valley
Coca-Cola knocked the school bus into a water-filled
pit.
Two months ago, the soft drink company agreed to
pay $1.5 million in a structured settlement with a family
of one of the dead students. It is the only wrongful
death settlement finalized in the case to date.
Of the 60 students injured, only three cases have
been settled, each for $250,000.
San Antonio attorney Ruben Sandoval, who rep
resents one family that lost a child in the wreck, told the
AP he knew' of some negotiations, but that his client had
not agreed to any settlement.
“We’re going to talk to our client and its up to her,”
Sandoval said.

ployees of a private jail faced FBI
lie detector tests Tuesday in con
nection with the escape of three
inmates, including a suspected
drug kingpin.
The three prison cellmates —
Mario Alberto Salinas Trevino,
Charlie Edward Compton and
Juan Chapa Garza — left the
Central Texas Parole Violators
Facility late Sunday after pulling
a gun on an unarmed guard, offi
cials said.
Salinas was among 25 people
arrested last year in “Operation
Jet Set,” a series of raids by fed
eral authorities in California and
Texas. Salinas, 37, is the sus
pected leader of one of the larg
est drug-smuggling and money
laundering rings between Texas
and Mexico, authorities said.
Officials believe Salinas headed
to Mexico, 150 miles away, be
cause he may have access to mil
lions of dollars there.
“That’s a logical escape route,”
U.S. Marshal Bill Jonas said. “If
that’s the case, I think he’s acting
ill-advisedly. I have every reason
to believe the Mexican govern
ment will cooperate with us.”
Customs agents on both sides
of the border were alerted to the
escape, and photographs of the
three inmates were circulated
among area police departments
and news organizations.
Compton, who has strong ties
in San Antonio, was awaiting trial
on charges of possession of co
caine with intent to distribute,
Jonas said.
Chapa was charged with pos
session of marijuana with intent
to distribute.
The fugitives’ cases were not
connected, Jonas said. However,
he added, “I would think that the
three of them would stay together
for awhile.”
DALLAS (AP) — The body of a
Garland man who may have been a
casualty of this weekend’s violent
storms was pulled from a North Dal
las creek Tuesday afternoon, au
thorities said.
Dallas Police Sgt. Jim Chandler
said authorities were using a crane to
remove a car containing the man’s
body from Floyd Branch, which
feeds into White Rock Creek.
Chandler identified the dead man
as So Kim, 46, of Garland.
Kim apparently tried to drive his
car through high water resulting
from Sunday’s heavy rains and was
swept into the creek. Chandler said.
“The vehicle was swept into the
creek and traveled down until it hit a
concrete abutment at LBJ (Free
way),” Chandler said. The 1980
