neys plan to ask for changes in the
unusual joint order signed earlier
this month requiring the state and
Harris County to reduce the number
of state prisoners in the county jail.
The attorneys say they will ask
federal Judges William Wayne Jus
tice of Tyler and James De Anda of
Houston to clarify — if not modify
or even delay implementation of —
the order.
“It’s a question of whether we can
meet what the court is asking us to
do,” Kirk Brown, general counsel
for the prison system, said.
The crux of the issue is interpret
ing what the court meant when it or
dered a net reduction of 9,130 pris
oners in the jail by Aug. 31, assistant
Attorney General Bob Ozer, who is
representing the state in the lawsuit,
said.
The order, signed March 15 but
made retroactive to Feb. 1, specif
ically requires that 300 state prison
ers be removed from the county jail
by May 31 and another 300 by Aug.
31. Brown said the confusion lies in
whether that means 600 more than
the state already has moved or is
projected to remove through its nor
mal channels.
If fewer than 300 have been re
leased by May 31, some jail inmates
will automatically have 30 days
shaved from their sentences.
The prison system can remove
prisoners from county jails three
ways: by accepting them into state
facilities, releasing them on parole
directly from jau or transferring
them to a halfway house before be
ing released on parole.
“Our concern with the language
of the order is that it seems to imply
that we are supposed to take 600 in
mates in addition to what we can
take out (by those three means),”
Brown said. “That is troublesome to
us because we are unaware that we
have any other mechanism by which
we can take them out."

James Hickey, who testified in a drug trial that he didn’t
object to informants offering sex in exchange for
drugs, now says he has begun to question the morality
of undercover practices.
“Undercover officers have to live a lie. They have to
have another identity altogether,” Hickey said. “My
thoughts were, ‘What are we doing to these officers?
How does it affect their lives?’ ”
Hickey is reviewing techniques used by undercover
officers and the possible moral questions raised when
those officers must lie.
Seeking answers, Hickey has turned to moral theolo
gians, whom he declined to identify, for their opinions
on whether deceit used in undercover work presents
moral problems.
Hickey hasn’t instituted any departmental changes,
but said he has made it clear to the officers that sex
should never be offered — by officers or informants —
in exchange for drugs.
The sheriffs qualms surfaced during last week’s trial
of David Gordon Underbrink, who was convicted of de
livery of cocaine. He w-ill be sentenced April 23.
A pretrial motion by defense attorney Albert Pena
III asserted that a female informant performed oral sex
on Underbrink in the women’s restroom of a bar last
November.
The informant, a former prostitute, testified that she
did not provide sexual favors for Underbrink, but that
she did agree to go home with him if he would give her
boyfriend some cocaine.
Hickey testified during Underbt ink’s trial that he
didn’t object to informants offering — but not supply
ing— sex in exchange for drugs, if that’s what it took to
catch narcotics dealers.
But the sheriff said he later began to question the
morality of undercover practices.
“I got to thinking about it, and it really bothered me,”
Hickey told the Corpus Christi Caller-Times. “This is
the first time this has ever come up. Nobody in thedt
partment had authorized that. It was (the inforraanti
own idea.”
Some law professors said the offer of sex may notli
illegal, but it is considered unethical.
Paul Rothstein, a professor at the Georgetown:Uni
versity Law Center in Washington, said that whena
fendant claims entrapment, the courts exam®

“When it goes too far, there are some constitution!
and legal problems,” Rothstein said. “If it isjusttheo!

Ron DeLord, president of the Combined Law En
forcement Association of Texas, said there are some
things that officers certainly should not do — like ex
changing sex for drugs — but that on the whole, then
are no clear-cut rules about what undercover officer!

“It’s not black and white. I think common senst
should prevail,” DeLord said.
