MHMR struggles to meet deadlin
AUSTIN (AP)— The Texas mental health de
partment indicated it may fail to make court-or
dered improvements by a 1991 deadline,
prompting a federal judge to warn the agency it
could face contempt proceedings.
The Texas Department of Mental Health and
Mental Retardation has said it could take as long
as five years to improve rehabilitation programs
that don’t have enough money.
But U.S. District Judge Barefoot Sanders has
ordered that those programs and other issues in
the 16-year-old class action suit be resolved by
June 1, 1991.
In an order released Monday, Sanders said he
expected full compliance with the deadline or
else the state “will be subject to contempt pro
ceedings,” the Austin American-Statesman re
ported.
Sanders warned last year that he would impose
sanctions against the state if his orders are not
followed.
In 1987, the state faced millions of dollars in
fines when it could not meet another federal
judge’s order to improve conditions in state pris
ons.
The state avoided the fines after the Legis
lature made an emergency appropriation of
$20.4 million.
In the mental health case, the department re-
3 nested $105 million in 1990-91 for court-or-
ered reforms, but received $60 million from the
Legislature.
Last week, Legislative Budget Board director
Jim Oliver told lawmakers that the MHMR
agency said it needs another $42.1 million to
completely comply with the court-ordered set
tlement.
The department has yet to comply with orders
requiring that: mentally ill patients get 30 hours
per week of psychological and social rehabilita
tion programs tailored to individual needs; qual
ified psychiatrists be employed; patients receive
proper medical treatment; and patients’ rights be
protected.
Dr. David Bean, deputy MHMR commissioner
for mental health, said the department “will cer
tainly evaluate whatever we need to do to
tain compliance with the judge’s orders.”
“It is at least my intent that we certainly
within the parameters set by the court, 1

hospitals for the court, said the department!
