Where’s the pork?
Pigstands, Hard Rock battle
for use of Tig Sandwich’
SAN ANTONIO (AP) — A dis-
ute over the term “Pig Sandwich” is
ogging the limelight in a federal
court pork clash between San Anto
nio-based Pigstands of Texas restau
rants and the Hard Rock Cafe of
Dallas.
Pigstands claims it has the exclu
sive right to sell the “Pig Sandwich”
and is suing the Dallas Hard Rock
Cafe, which sells its own version of a
“Pig Sandwich.”
Pigstands claims use of the term
“Pig Sandwich” is an infringement
of its service mark — a pig with the
words “Pig Sandwich” inside. A serv
ice mark is similar to a trademark
but involves a service rather than a
product.
Louis Perkey, an attorney for
Pigstands, claims “Pig Sandwich” has
been the mark of Pigstands for 70
years and is known to generations of
Texans as such.
. But Fred Shannon, a lawyer for
Hard Rock Cafe, said the term “Pig
Sandwich” is generic for any kind of
pork sandwich, and Cafe’s use does
not infringe on the rights of Pigs
tands.
A six-person jury seated before
U.S. Magistrate John Primomo is de
ciding the case, which is expected to
last until Friday. Testimony began
Monday.
Among the unusual evidence in
the courtroom is a glaring 3-by-4foot
red neon pig sign with “Pig Sand
wich” lit in green neon. The 65-year-
old sign has been on display at the
Pigstands restaurant near downtown
San Antonio throughout the compa
ny’s history.
