rors in a capital murder trial are get
ting the opportunity to perform a
task normally reserved for lawyers: a
judge has let the jury ask questions
of witnesses.
“I’ve been wanting to do this for
over two years,” said state District
Judge Joaquin Villarreal, who on
Tuesday began experimenting with
the procedure used in some other
states.

the first time he’s heard of a judge in
Texas allowing the jury to question
witnesses.
“I think it’s a terrific idea,” Daw
son told the Corpus Christi Caller-
Times.
Neither statutory nor case law
prohibits the procedure, he said.
Judges are given wide discretion so
long as their procedures maintain
fairness, Dawson said.
But defense attorney Fred Jime
nez objected to the procedure Tues
day, arguing that he didn’t believe it
was proper for a jury to question wit
nesses, and said there were no provi
sions in Texas law allowing it.
“I have problems with trying
something new in a case of this im
portance, Jimenez said during a

Defendant Juan Hernandez, 25,
faces death by injection or life in
prison if convicted in connection
with the March 29, 1988, slaying of
Santos Briones, 74, of Corpus
Christi.
Villarreal warned the jurors Tues
day that some of their questions
might not get asked. He told them
not to get angry if that happened be
cause the law dictates that the court
follow certain rules.
The procedure adopted by Villar
real is patterned after one employed
by judges in Milwaukee County,
Wis., and publicized in the Jan. 29
edition of tne National Law Journal.
After each witness was questioned
in the conventional manner by the
prosecution and defense attorneys,
Villarreal asked jurors if they had
any questions. The jury was sent out
of the courtroom while their un
signed, handwritten questions were
collected.
The questions were studied by the
judge, Nueces County District Attor
ney Grant Jones and defense lawyer
Jimenez. Both lawyers were given a
chance to object to the questions, ar
guments were heard and the judge
ruled on whether to allow the ques
tions to be asked.
The jury was then brought back
into the courtroom and Villarreal
asked the approved questions.
