Bill would stiffen penaltie
for unscrupulous lawyers
AUSTIN (AP) — The Texas Sen
ate approved a bill Thursday that
would stiffen penalties against attor
neys who try to solicit business in an
unscrupulous manner during a crisis
situation.
Sen. Hector Uribe said his bill was
a response to complaints about attor
neys after the July 7 roof collapse of
a three-story department store in
Brownsville that killed 14 people
and injured 47 others. The collapse
occurred under the weight of rain
fall trapped on the roof.
Uribe, D-Brownsville, said lawyers
descended on the families of victims
like “a horde of locusts.”
Penalties would range from a pos
sible jail term of one year and $2,000
Fine, or both, to a possible Fine of
$5,000 and maximum prison term
of 10 years.
The bill was approved on a voice
vote and sent to the House.

The bill would increase penalties
against attorneys or their represen
tatives who try to solicit business at a
hospital, funeral parlor, cemetery or
accident scene, or impersonate a
clergyman, emergency worker or
public employee.

disputed tax funds that will add
about $168 million to state coffers
over the next two Fiscal years,
according to an analysis by the Legis
lative Budget Board.
The bill by Sen. Kent Caperton,
D-Bryan, would allow the state com
ptroller to delay refunds from tax
lawsuits to the beginning of the two-
year budget cycle following the date
of a final courtjudgment.

House OKs bill
to let doctors test
patients for AIDS
AUSTIN (AP) — The Texas
House on Thursday tentatively ap
proved a bill that would allow doc
tors and hospitals to administer
AIDS tests witnout specific consent
from the patient.
The bill by Rep. Billy Clemons, D-
Pollok, would modify 1987 legis
lation requiring special consent for
AIDS testing.
Under Clemons’ bill, patients
could be asked to sign a specific con
sent form for AIDS testing or they
could be tested by signing a general
consent form for medical tests,
which would not specify AIDS test
ing.
After lengthy debate and a de
feated motion to table the measure,
House members passed it in a non
record vote. Another vote is re
quired for final passage.

David Jef ferson, a registered sanitarian at the department, says
restaurants with scores of 95 or above generally have excellent oper
ations and facilities. He says restaurants with scores in the 70s or low
80s usually have serious violations in the health report.
Scores can be misleading, Jefferson says, because restaurants can
gel the same score by having several minor violations or a few major
violations. He says the minor violations can be corrected during the
inspection. Point deductions or violations in the report range from
one point (minor violations) to five points (major violations).
Jefferson says the department might close a restaurant if: the
score is below 60, the personnel have infectious diseases, the restau
rant lacks adequate refrigeration, there is a sewage backup in the
building or the restaurant has a complete lack of sanitization for the
food equipment.
The department inspects each restaurant every six months. Jef
ferson says a follow-up inspection is sometimes required if a restau
rant has a four- or five-point violation that cannot be corrected dur
ing the inspection, or if there are numerous small Violations.
Inspectors at the department are registered sarritarians.
