FLORIEN, La. (AP) — Family
and friends of Loyal Garner Jr.
gathered at a local high school audi
torium for a memorial tribute to the
truck driver who died of head
wounds after being jailed in the Sa
bine County Jail.
Police Chief Duane Calhoun
fought back tears Saturday as he de
scribed his friendship with Garner
and he pledged to help Garner’s
widow and six children.
Calhoun said he knew Garner as
he grew up and never saw him do
anything wrong.
Garner, 34, died Dec. 27, at Tyler
Medical Center after surgery for
head wounds he received at the jail
in Hemphill.
Former Hemphill Police Chief
Thomas Ladner, 41, and sheriffs
deputies Bill Horton, 58, and James
“Bo” Hyden, 35, were acquitted July
15 of violating Garner’s civil rights
by beating him and denying him
medical attention.
The 12th District Court of Ap
peals ruled Wednesday the trio can
not be tried for murder in Smith
County because it would constitute
double jeopardy trying someone
twice for the same alleged offense.
Florien Mayor John Manasco said
the people of Florien know a wrong
has been committed, but the ques
tion is why did we permit it to hap
pen.
“I don’t agree with the courts in
Texas, but someday it will be
righted,” Monasco said. “I knew Ju
nior (Garner) to be honest and hard
working. He was loved by his family.
“It is incomprehensible that some
thing like this could happen,” he
said.
The Rev. Ernest Charles of Hous
ton said he has talked to many whites
who feel Garner’s death was racially
motivated.
The three law men were white
and Garner, black.
“In spite of the fact that racism ex
ists we who are for righteousness
must rise above racism,” he said.
“We must recognize a man for being
a man, not the color of his skin, but
the truth he has in his heart.
“Loyal died and he will never
come back, but he died to bring us
all together for a better place. If
Loyal had not lost his life we would
not be here today. We must stand up
and say he did not die in vain,”
Charles said to loud applause.
The group of about 50 who at
tended the service contributed a to
tal of $317 for the Garner family.
The money was taken up by Florien
police officers.

Conservative group attacks

DALLAS (AP) — A conservative group has launched
a crusade against Baylor University trustees and its
75,000-member alumni association saying the groups
have allowed the school to become too liberal.

In a four-page letter to Baylor friends and alumni,
the Rev. Donny Cortimilia urged conservatives to at
tend the Nov. 4 Alumni Association meeting and vote
to change the editorial policy of The Baylor Line, the
alumni journal.
