AUSTIN (AP) — A state appeals court Wednesday threw out a crimi nally negligent homicide conviction against Peabody Southwest, Inc., in the cave-in death of a construction worker. Peabody appealed to the 3rd Court of Appeals, which ordered ac quittal in the July 17, 1985, death of Jdargarito Maldonado, who was killed when the trench he was work ing in collapsed on him. The state charged Maldonado’s employer with criminally negligent homicide for failing to properly slope and shore the walls of the trench. Peabody alleged that the trial court lacked jurisdiction in the case because state law was preempted by the federal Occupational Safety and Health Act. The trial judge denied the motion, and Peabody pleaded no contest. The judge accepted the plea and fined Peabody $20,000. Justice Jimmy Carroll noted that the court had held in two other cases determined on rehearing Wednes day that federal law preempts state criminal prosecutions based on workplace safety conditions. Texas’ assistant attorney general abdicates post HOUSTON (AP) — The assistant attorney general who spearheaded reform of the Hermann Hospital Es tate and the Moody Foundation says he is resigning instead of taking a job transfer. John Vasquez, who now heads the state attorney general’s charitable trusts division, had been offered a transfer and promotion to become a special assistant attorney general in the consumer protection division but apparently was not given an option to remain in his current job, officials said. “I think I have accomplished a lot in this office, but I think I can serve those concerns I most care about probably best outside the (state) agency,” Vasquez said Tuesday. Vasquez submitted his letter of resignation this week to Attorney General Jim Mattox, effective Sept. 16. He will be replaced by Rose Ann Reeser, an assistant attorney general in the Houston consumer protection office, said Ron Dusek, spokesman for the attorney general. Vasquez, 33, has been with the at torney general’s charitable trusts of fice since 1984. “I’m resigning because I think it’s in my best interest and in the best in terest of my public policy concerns,” he said. “I want to continue to do good things. I hope I can, and I be lieve I can.” His resignation comes on the heels of his creation of a controver sial statewide task force to study the delivery of indigent care by non profit hospitals. The task force, which grew out of his investigation of the scandal-plagued Hermann Hospital Estate, has drawn fire from the powerful hospital lobby. Dusek, however, said political dif ferences were not the reasons for the proposed transfer of Vasquez out of the charitable trusts division. “We have big, important cases not only in the charitable trust division, but also in the consumer protection area,” Dusek said. “We would have made the best use of the talents that he has. During his tenure, Vasquez headed several major investigations of charitable trusts in the Houston Air-show victims receive treatment in Texas hospital SAN ANTONIO (AP) — Four military personnel will spend up to eight weeks in a burn treatment fa cility after suffering third-degree burns in an air show disaster in West Germany, physicians said Wednes day. Three Americans and an Italian are being treated at Brooke Army Medical Center, which was expected to receive a family of three Ameri cans from the same crash late Wednesday. The four servicemen arrived early Wednesday via a C-141 cargo plane from West Germany and were taken to the burn unit about 2 a.m. They were identified as Air Force Master Sgt. Stephen Hull, 31, sta tioned at Kelly Air Force Base in San Antonio; Army 1st Lt. Kim Strader, 41, -of Salt Lake City; Army Pfc. Myron Riggs, 24, of Pittsburgh; and Anderea, or Andrew, DelaRosa, 33, a sergeant major assigned to the Ital ian Embassy. “The extent of burns ranges from 21 percent to 65 percent of the total body surface,” Dr. Basil Pruitt, head of the world-renowned burn unit, said about the victims. “In all of the patients, the majority of the burns are third-degree, which means that considerable skin graft ing will have to be done to close the wounds,” he said at a news confer ence.
