In their most important civil rights decision of the year, the jus tices expanded the way employees can use statistical evidence to prove bias, making it easier for workers to prove their bosses are guilty of ille gal discrimination. Watson’s lawsuit now will return to a federal trial court. She and her lawyer talked about the case Wednesday at Harris Meth- odist-HEB Hospital, where she has been treated for kidney trouble. Watson, who uses a wheelchair be cause of her illness, said filing the lawsuit cost her “dear friends” at work. “They thought I shouldn’t make waves, that I should let it be,” Wat son said of her co-workers. She said she and her husband were divorced after he refused to support her suit. Unable to find work at other Fort Worth banks — “word got around” of the suit, she said — Watson took a job cleaning cabins for American Airlines. She has been unable to work since last year, when she began dialysis for kidney failure. “It is really an important, land mark case in the area of civil rights and discrimination,” Watson’s law yer, Art Brender said, “because it says that you don’t have to prove in tent to discriminate — that discrimi nation can be based on stereotypical views that people make without actu ally proving intent.” The decision, although involving a complicated aspect of federal anti bias law, carries a significant, direct impact on numerous lawsuits filed by women and racial minority mem bers who say they have been treated unfairly. After seven years’ at Fort Worth Bank & Trust, four times in 1980 and 1981 Watson applied for super visory jobs and was passed over in fa vor of people with as little as six months experience, Brender said. Watson sued in 1981, saying in part that the bank discriminated against all blacks in its hiring prac tices. The part of the Civil Rights Act of 1964 known as Title VII bars on- the-job discrimination based on race, gender and other factors. In a key 1971 decision, the Su preme Court ruled that Title VII vi olations can be proved by using sta tistics to show that some practice or policy, although not intended to be discriminatory, unduly hurts rtii- norities or women. The court in 1971 said a compa ny’s use in hiring of written aptitude tests and its requiring high school di plomas, although intended to be ra cially neutral, was illegal because the practices “disproportionately ex cluded blacks from employment.” The court in that case said the tests and diploma requirement had no “demonstrable relationship to successful performance on the jobs” for which the tests were used. In most cases, such “disparate im pact” is far easier to prove than showing “disparate treatment” or in tentional discrimination. ZAVALLA (AP) — A federal judge Wednesday closed the entrance to the main camp of the back-to-na- ture Rainbow Family after the group exceeded the 300- person limit allowed inside to construct a camp for thousands of others. Federal marshals and U.S. Forest Service officials said as many as 750 members of the Rainbow Family were camped at an area known as Mud Flats on Lake Sam Rayburn in the Angelina National Forest, site of the loosely-knit group’s 17th annual nationwide reun ion. Texas Department of Public Safety officers and For est Service officials blocked the main road into the campsite after U.S. District Judge William Wayne Jus tice issued the order. Last week Justice ended weeks of litigation by allow ing the group to meet in the East Texas forest about 125 miles northeast of Houston. His order, however, placed limits on the number of people in the camping areas until proper health and sanitary facilities could be built. Justice’s order Wednesday decreed the campsite be closed until either 300 or fewer people were there or until the site was in compliance with the health stan dards. “People are warned before they leave that they can’t return unless they are coming in with food, water, med ical supplies or construction material,” Forest Service spokesman Carl Gidlund said. Also Wednesday, federal health officials arrived to begin inspections of the facilities. Approval by the U.S. Public Health Service will allow up to 5,000 people at each of six designated campsites. In addition, U.S. Customs Service officials arrived Wednesday with drug-sniffing dogs in an effort to curb what authorities believe will he considerable illegal drug use at the campgrounds. Forest Service spokesman Doug Williams said the at tendance will fall below the 20,00 campers officials have been preparing to handle.
