upheld by the U.S. Supreme Court,
bans nude adult entertainment from
within 1,000 feet of a home, church
or school.
John Laemlein, attorney for the
owner of three nude-dancing clubs
that were not granted extensions in
Tuesday’s council action, said he
might appeal the decisipn in court.
An alternative, he said, is for
owner Tony De Santio to change his
businesses to comply with the zoning
law. Having dancers wear minimal
clothing probably would bring the
clubs into compliance.
Richard Lovelace, attorney for the
owners of two adult book stores, said
after Tuesday’s council meeting that
the case “will move into the legal
arena.”
Existing businesses in violation of
the new ordinance when it was -
passed last year were allowed to re
main in operation for 12 months. To
stay in business longer, owners had
to prove they had not yet lecouped
their investments.
But the five businesses were
turned down as council members
made verbal swipes at the owners.
“Why should we consider exten
sions on these sleazeball opera
tions?” Mayor Jonathan Rogers said.
