FBI director: Judiciary should do more
to balance rights of defendants, media
SAN ANTONIO (AP) —The ju
dicial system should do more to pro
tect defendants’ rights while not in
fringing on journalists' First
Amendment protection to cover
news events, FBI Director William
Sessions, says.
Sessions, a former federal judge
in San Antonio, was one of several
panelists attending a media-law
seminar Saturday at the University
of Texas at San Antonio.
Arthur Miller, a Harvard law pro
fessor, was the moderator for the
panel that also included lawvers, law
officers, journalists, judges and
Mayor Henry Cisneros.
The panelists discussed how they
would handle the fictional case’ in
volving the arrest of Dirk Dougan, a
Nazi who was suspected in a string of
murders.
Journalists said they would devote
a great deal of time and resources to
uncovering Dougan and the latest
v ictim’s past.
Others panelists discussed how
they would handle the case in their
respective jobs.
Sessions said of ficials should get a
defendant in and out of public
buildings through the back doors.
“In a sense vou are dealing with
that person’s right carefully,*’ Ses
sions said. "Even though the media
is still out there, you haven't sub
jected him to those things that de
prive him of those equal rights.
“In the management of the court,
gentlemen, you need to say, ‘We
must be sure that we have a system
to afford these people their right not
to be made a spectacle of .'
“The media has an absolute re
sponsibility to pursue a story. The
media can make a zoo out of it if it's
allowed to happen.”
Reuben Greenberg, police chief in
Charleston, S.C., said he would al-
wavs trv to get a murder suspect
away from journalists so that a pic
ture of the defendant would not
prejudice potential witnesses.
“You don’t want his picture in the
paper or on television,” Greenberg
said. “It would taint the case. You
would be doing the defense's work
for them.”
He also defended journalists'
rights to cover a story.
“I think we accept them being the
re," Greenberg said. "We accept it as
a part of the ritual."
Cisneros said that he would like to
see a balanced story of the victim,
but would prefer a postive rather
than negative story about the vic
tim’s past.
