ment. The information is based
on food service establishment re
ports.
SCORED BETWEEN 95 AND
100:
Orange Julius at 1500 Harvey
Road was inspected by Mike Les
ter. Score— 100.
Arby’s at 1800 Southwest
Parkway was inspected by David
Pickens. Score— 100.
Cindy’s Cinnamon Rolls at
1500 Harvey Road was inspected
by Mike Lester. Score — 98. Two
points were subtracted in the re
port because an ice scoop was not
stored properly and food con
tainers were not labeled.
Subway Sandwiches and Sal
ads at 2418 Texas Ave. was in
spected by David Pickens. Score
— 95. A five-point violation was
cited in the report because meat
sauce was kept at an improper
temperature.

stored above food. Four points
were subtracted in the report be

ice scoop was stored on top of a
dirty ice maker. Two additonal
one-point violations were cited in
the report because an unused ice
machine needed removing and a
floor needed cleaning.
Michael’s Restaurant at 2406-
C Texas Ave. was inspected by
David Pickens. Score — 85. Four
points were subtracted in the re
port because a hand sink was in
accessible. Four two-point viola
tions were cited in the report
because a men’s room needed
soap, dishwashing facilities were
not being operated properly,
there was food splattered on
equipment, and food contact sur
faces were not properly main
tained.
Roccos at 509 University Drive
was inspected by David Pickens.
Score — 77. Five points were de
ducted in the report because a
restroom had no hot water. Two
four-point violations were cited in
the report because a hand sink
was inaccessible and a rear door
needed to be adjusted to be self
closing. Three two-point viola
tions were cited in the report be
cause there were no soap or tow
els at a hand sink, food was
splattered on shelves, and food
was stored on the floor of a walk-
in cooler. An additional four one-
point violations were cited in the
report because ceiling tiles
needed replacing, a dumpster
area needed cleaning, a water
leak behind an ice machine
needed repairing, and non-food
contact surfaces were dirty. The
inspection was performed in re
sponse to a customer complaint
about an odor coming from the
dumpster. A follow-up inspection
was performed.
David Jefferson, a registered sanitarian at the department, says res
taurants with scores of 95 or above generally have excellent operations
and facilities. Jefferson says restaurants with scores in the 70’s or low
80’s usually have serious violations in the health report.
Scores can be misleading, Jefferson says, because restaurants can
get the same score by having several minor violations or a few major vi
olations. He says the major violations can be corrected during the in
spection. Point deductions, or violations, in the report range from one
point (minor violation) to five points (major violation).
Jefferson says the department might close a restaurant if the score is
below 60, the personnel has infectious diseases, the restaurant lacks ad
equate refrigeration, there is a sewage backup in the building, the res
taurant has a complete lack of sanitization for the food equipment.
I he department inspects each restaurant every six months. Jeffer
son says a follow-up inspection is sometimes required if a restaurant has
a four- or live-point violation that cannot be corrected during the in
spection, or if there are numerous small violations.
Inspectors at the department are registered sanitarians.
Capital murder
dismissal angers
police, prosecutor
HOUSTON (AP) — The dis
missal of capital murder charges
against a former Lamar University
coach who spent years on death row
has enraged prosecutors and police
who say the justice system failed.
State District Judge Johnny Ko-
lenda dismissed two capital murder
charges against Vernon Eugene Mc
Manus Wednesday because the
state’s key witness refused to testify
in a new trial.
“In this case, it appears the crimi
nal justice system has failed, at least
for now,” said Baytown Assistant Po
lice Chief Robert Merchant, whose
department helped build the case
against McManus.
McManus was sent to Texas’
death row in June 1977 after being
sentenced to die for arranging the
slayings of a Baytown couple, Paul
and Mary Cantrell, and killing Can
trell, an electrical contractor.
But a federal judge, citing an er
ror in jury selection, overturned Mc
Manus’ conviction in June 1983 and
ordered the new trial.
“I think there should be some
time and numerical limitation on the
numbers of appeals a (defendant)
can have,” Mike Hinton, who pros
ecuted McManus in his first trial,
said.
“His case was affirmed twice by
the Court of Criminal Appeals and
at least once — maybe twice — by the
5th Circuit Court of Appeals, and it
was even denied by the U.S. Su
preme Court,” Hinton said.
Harris County District Attorney
John B. Holmes Jr. said prosecutors
had to ask for dismissal because they
lacked enough evidence to convict
McManus when the slain couple’s
daughter, Paula Cantrell Derese, re
fused to testify in the new trial.
Kolenda refused to allow her pre
vious testimony to be admitted into
the new trial because he said McMa
nus’ previous attorney had inade
quately cross-examined her.
Derese, serving two concurrent
life sentences in connection with her
parents’ slayings, has refused to co
operate with officials because she
said they reneged on a deal to
shorten her prison term.
Louise Fellows, a real estate agent
who lives down the street from the
late Cantrells’ residence, said some
people who lived near the couple
moved because of the killings.
But she added that “I’ve never
been sure he (McManus) was guilty.”
Texas hospital
will research
artificial heart
LUBBOCK (AP) —- Methodist
Hospital has been selected as one of
six sites in the nation to perform
clinical investigations with a new
heart-assist device based on the de
sign of the Jarvik-7 artificial heart.
A Lubbock cardiovascular sur
geon who now is authorized to im
plant the device said the research
will be of vital importance.
“We estimate that the lives of be :
tween 12 and 20 patients a year can
be saved with this device” in the Lub
bock area, Dr. H. Andrew Hansen,
said Wednesday.
Other centers chosen are in Mem
phis, Tenn.; Fort Wayne, Ind.; Chi
cago (two sites); and Tucson, Ariz.
The Acute Ventricular Assistance
Device, called AVAD, is an external
system of plastic tubing implanted
during heart surgery, Hansen said.
“AVAD bypasses the side of the
heart that is injured or in failure and
allows the heart to recuperate,” he
said. As the patient’s heart becomes
stronger, it is weaned from the de
vice until it can function on its own.
Hansen said the device will b<
used at the hospital in early spring.
