Court closes school,
keeps pastor out of jail
AUSTIN (AP) — A state district
court approved late Monday an
agreement between the Rep. W.N.
Otwell that will keep him out of jail
but prevent him from operating a
children’s home without a license.
Otwell, who fled the state five
weeks ago to escape a contempt of
court order, surrendered Monday
and was brought to Austin.
“I appreciate the judge not incar
cerating me,” Otwell said after the
brief court hearing. “I still think the
law is wrong and will try to get it
changed in the next Legislature.”
“I think they made the right deci
sion to close the school and go to the
Legislature,” said Attorney General
Jim Mattox, who appeared before
District Judge Paul Davis.
Otwell contends that getting a
state license for the Tarrant County
home would violate the separation
of church and state guarantees in
the Constitution.
Davis ruled after Mattox and
Shelby Sharp, Otwell’s attorney, said
an agreement had been reached.

not to operate the school for trou
bled boys until, and unless, the Leg-

Davis approved the agreement
prohibiting operation of the school.
He also agreed to suspend pay
ment of $67,000 in fines levied
against Otwell and the church.
“That includes a waiver of any
possible jail sentence,” he said, ref-
fering to the contempt of court ac
tion.
But he lectured Otwell sternly.
“You took it upon yourself to de
cide whether to follow a law,” Davis
said. “That is a very unfortunate
message you have given a lot of peo
ple.”
Otwell said he was serious at all
times in his actions.
“I wasn’t playing games,” he said.
“We felt the courts and the state had
been unjust to us.”
Otwell surrendered to Tarrant
County Sheriff Don Carpenter at
Forest Hill.
“We just looked at some options
and Cod gave me some peace,” Ot
well told a news conference there. “I
was very uneasy about coming back
to Texas, but I was satisfied that’s
what Cod wanted.”
