toughen penalties
for drug offenders
HOUSTON (AP) — Juries in
Houston are giving tougher sen
tences to convicted drug offenders
as public opinion swings back to a
general alarm about drugs, prosecu
tors and defense attorneys say.
Last week, a jury gave a 40-year
prison term and a $5,000 fine to a
22-year-old Houston man for pos
sessing one gram of crack. He had
had one previous aggravated rob
bery conviction.
“I was shocked,” prosecutor
Gladys Aguero said. “I never
thought they were going to give 40
years.”
But prosecutors and defense at
torneys agree many Houstonians in
creasingly are reacting in alarm to
drug use and the social ills it may
cause.
But defense attorney Mike De-
Geurin says he worries about juries
looking more at the alleged offense
rather than the individual involved.
The Houston Post repot ted Sun
day that the average prison term for
Harris County felony drug convic
tions has increased from about f ive
years in 1983 and 1984 to about six
years in 1985.
Recent sports scandals and Presi
dent Reagan’s anti-drug campaign
have contributed to the public’s
awareness, he said.
Defense attorney Wendell Odom
Jr. said juries now are more reluc
tant to grant probation to drug of
fenders.
That attitude will get tougher,
prosecutor Rusty Hardin predicted.
The judge and many defense at
torneys said prison is not the only
answer to the problem. Drug educa
tion must play a major role in the fu
ture, they said.
