Gary Brown, chief deputy with the Presidio County sheriffs office, said Tuesday that an investigation by his department did not produce any arrests at the time of the July 24 at tack, which occurred near Presidio, located near the Mexican border. On July 30, Presidio County dep uties arrested three Odessa men near the border and charged them with unlawfully carrying weapons. Hugh Rushton, chief U.S. Border Patrol agent for the Marfa sector, said his agents are investigating the reported assault and the arrests. Civilian Materiel Assistance, a paramilitary group, started patrols last month in Arizona with the stated aim of stopping drug trafficking across the border. “We have not been able to link them with any paramilitary opera tions,” Rushton said of the arrested men. “And they do not claim to be a part of the CMA.” Last month, CMA came under scrutiny by officials after several group members stopped illegal aliens in Arizona for questioning. The group later decided tocailofi its plans for border patrols. Belyeu, 27, of Cleburne was found guilty in the stabbing and shooting death of a West woman. The punishment phase of the trial adjourned at 4 p.m. and will resume at 9 a.m. today. Belyeu was convicted of the Dec. 10, 1985, slaying of Melodic Bolton, the wife of a prominent Central Texas businessman. Another Cleburne man, Earnest Ray Moore, 21, also is charged with the slaying.The two are being tried separately because Belyeu has a prior felony conviction while Moore does not. No trial date has been set for Moore. Ken Abies and Fred Horner, Be- lyeu’s court-appointed attorneys, called two witnesses who testified for less than 30 minutes. Defense witness Roger Smith, of the Dallas County Institute of Foren sic Sciences, testified that he com- E ared footprints found in Bolton’s ouse in West with the soles of ten nis shoes found in Belyeu’s trailer home. Smith said he could not positively identify the left tennis shoe as the shoe that made the footprint. Richard Donald “Stony” Foster was believed to be hiding in the rugged terrain near Possum King dom Lake, officials said. “We’re not going to let him wait us out. . .” said Stephens County Sher iff James Cain. “I personally think he’s still in this area.” Foster, 33, and another inmate es caped Sunday night from the Ste phens County Jail. Texas Ranger Billy Peterson said, “We’ll search ’til that sucker’s caught.” Palo Pinto County Sheriff John Turpin said there were no leads in the case. “Everything’s the same,” said Tur pin. “We’ve got nothing. We’ll just keep searching the same area. Turpin said the escapee may have taken refuge in a house. “The problem is that some people in the homes in the area are gone for a few days,” he said. “Some are there only on weekends. We don’t know.” Former lawyers for the Vietnam veteran have said Foster is suffering from war-related stress and will not give up easily. Fort Worth lawyer Jim Lane said, “I think I know where he is, at least in his own mind. He’s back on the Mekong Delta in Vietnam.” Peterson called Lane’s theory “pure nonsense.” Inmate Cindy Davis, 27, who es caped with Foster, was captured Monday morning on the east side of Possum Kingdom Lake, about 25 miles northeast of Breckenridge. At the time of the escape, Davis was being held on a charge of at tempted capital murder for alleg edly shooting at a police officer.
