AUSTIN (AP) — The U.S. Su
preme Court’s decision Monday al
lowing death penalty opponents to
be barred from capital murder case
juries means Texas executions can
move forward at a quicker pace, At
torney General Jim Mattox said.
Among others, the decision ap
plies to the case of Jay Kelly Pinker
ton, who is scheduled to die by lethal
injection on May 15, Mattox said.
The high court, voting 6-3, de
cided an Arkansas case which had
raised questions about dismissal of
such jurors. Texas and 37 other
states had filed written arguments
on Arkansas’ behalf.
In its ruling, the Supreme Court
said the Constitution doesn’t pro
hibit removal of prospective capital
murder case jurors who state they
oppose the death penalty.
Assistant Attorney General Paula
Offenhauser said that argument had
been raised in appeals filed by seve
ral convicted murderers in Texas.
Pinkerton was sentenced to die
for the 1979 mutilation murder of
Sarah Donn Lawrence in Ana/ |
An apprentice meat cutter, Pit |
ton also was convicted of theme i
tion slaving of Sherry Welchin| I
arillo.
Pinkerton had faced an An; |
1985 execution, hut he wasgrafJ
a last-minute stay by the Supr-
Court pending the outcome of
Arkansas case.
Mattox said, “The Pinkertons |
is the most immediate tobeaffe

In its decision, the Supreme Co
said fair-trial rights are not hot
when death penalty opponent
excluded, for that reason, frot I
l ies that will decide guilt or ic
cence in cases in which death
possible sentence.
The decision reversed a fed
appeals court ruling that saidi
eluding all potential jurors who]
tbev could never impose a deaifj
tence creates a “conviction pr#
jury — and thus violates a:
fendant’s right to a fair trial.
