AUSTIN — A day after backing
the plan in a preliminary vote, the
House on Tuesday defeated a bill to
force felony probationers to do un
paid community service work.
Several blacks in the House said
Dallas Rep. A1 Granoff’s plan
sounded like slavery. The bill was
approved in a 66-63 tentative vote
on Monday. But it failed 62-75 in
Tuesday’s final vote.
“1 guess I got blindsided,” Gran-
off said afterwards.
His plan would have required
judges to make community servite
work part of felony probation.
Under current law, judges have
the option of ordering such work.
Under the Granoff hill, judges
would have had to set a community
work schedule of 40 to 1,000 hours,
with an eight-hour weekly maxi
mum.
“There js not a right to proba
tion,” Granoff said. “Probation is
something you’re lucky to get after
committing a felony.
“It’s not horrible. Going to the
Texas Department of Corrections is
horrible.”
During Monday’s debate, he said
probation is a joke in many cases.
Rep. Terral Smith, R-Austin, said
the work program could be a bu
reaucratic nightmare for local pro
bation departments.
“It sounds good, but I don’t think
it’s worth the cost,” he said.
Rep. Wilhelmina Delco, D-Austin,
agreed with two other black lawmak
ers who said it sounded like “slave la
bor.”
“We used to do that a long time
ago,” Houston Rep. Harold Dutton
said Monday. “We forced people to
work and they didn’t get paid. We
had a term for it — slavery.”
Granoff said, “Slave labor is at
TDC. Slave labor is not staying at
home with your family, doing a few
hours of work.”
