Karel Soucek, 37, plunged to his death Saturday night. He was inside a padded barrel which was to be dropped from the roof of the Astro dome into a tank filled with water 180 feet below. The barrel struck the rim of the tank, crushing Soucek’s chest and abdomen and fracturing his skull, the Harris County medical examin er’s office said. Soucek died about an hour after an ambulance took him to a hospital. Wolf said Soucek was the first per former to be fatally injured in the history of the show. About 40,000 spectators were present. Soucek, who last summer became the fifth person to survive going over Niagara Falls in a barrel, was to have been paid $20,000 for this stunt. Wolf said. Soucek and other performers in the show signed a form releasing Pace from liability in case of acci dents. Wolf said Pace screens hundreds of applications from would-be dare devils, selecting only those with es tablished professional backgrounds. But, she said, the nature of the stunts are left up to the performers. Information denied on corporate merge p lc Associated Press NEW ORLEANS — A U S. ap- eals court agreed this week with a ower court ruling that the state of Texas can’t see confidential pre merger information filed with the Federal Trade Commission by Chev ron Corporation and Gulf Corpora tion. The 5th U.S. Circuit Court of Ap peals said laws were passed specif ically to prevent just what the state of Texas has in mind — using the se cret information to block the Chev ron-Gulf merger. Claiming the papers were needed to assure state law was being fol lowed, Texas Attorney General Jim Mattox sought the information after Chevron and Gulf filed premerger information with the FTC in March, 1984. After denying requests by Texas and other states, the FTC subse quently entered into a consent agreement with Chevron and Gulf, subject to final approval, the 5th Cir cuit said Monday in reviewing the earlier developments. The similar lawsuits were filed by the states of Connecticut, Minnesota, Pennsylvania and Rhode Island af ter they, too, were denied by the FTC. The 5th Circuit got into the case when Texas appealed the U.S. Dis trict Court for West Texas’ refusal of the state’s request for the FTC infor mation. It claimed the 1976 Hart-Scott- Rodino (HSR) Act and FTC regula tions governing such mergers did not mean to deprive states of cojifi- dential information, so long as state attorneys general agreed to keep it confidential. The 5th Circuit disagreed. “Precisely the opposite tack is taken by HSR, which does not au thorize the FTC to make public any information,” said the appeals court’s 3-0 decision. “Rather, it exempts all informa tion submitted to the FTC and the Justice Department from disclosure under the Freedom of Information Act and requires that no such infor mation or material be made public with two stated exceptions for Con gress and its committees.” Domino’s Pizza Delivers...
