Fingerprints don’t match
in Fort Worth investigation
Associated Press
FORT WORTH — The single
piece of evidence linking a 25-year-
old man with the murder of a 20-
year-old woman was discredited
Tuesday by the Fort Worth Police
Identification Bureau, officials said.
Tarrant County Sheriffs officials
had believed that a fingerprint
found on the trunk of the woman’s
car matched one of Timothy Paul
Volkmar, so he was charged Sunday
in the shooting death of Lisa Grif fin.
But Fort Worth police experts
said Tuesday that the two prints do
not match, Assistant District Attor
ney Steve Chaney said, adding that
Tarrant County Sheriffs officials
later concurred.
Chaney said Volkmar may be re
leased Wednesday when the case
against him is expected to be pre
sented to a grand jury.
Griffin’s body, with a single gun
shot wound in the head, was found
in southwest Tarrant County on Jan.
10. She is one of five women from
southwest Fort Worth who are either
missing or dead, and police have
said the cases may be related.
“What I thought was the best
piece of evidence we had turned out
not to be so good,” Chaney said.
“That case was filed on the mini
mum evidence needed. If he was the
one, no one wanted to be responsible
for him going out and killing again.”
Chaney said the district attorney’s
office could dismiss the charge but
that it is better, procedurally, to take
the case to the grand jury once a
charge is filed.
Meanwhile, Volkmar was held in
the county jail in lieu of $100,000
bond and for violating the terms of a
f aevious probationary sentence, of-
icials said.

Woman
sentenced!
for abuse
Associated Press
HOUSTON — A woman w
failed through “ignorance" to letl
her 4-month-old daughter as miKf
as the infant needed to stay alive J
been sentenced to 10 months prol»[
lion on a charge of involuntary mat.
slaughter.
The woman, Charlene MaeSpo,
nemore Martinez, 28, pleaded t
contest to the felony manslauglitt|
charge and was sentenced on Mot
day by State District Judge I.Di|
Master.
Assistant District Attorney Bn
Beers said the child, who w<
less at death than she did at
^was fed primarily sugared wateraail
did not receive enough nourishmtt
to sustain her lif e.
However, Beers said that ih|
was no malicious intent on the pari
of the mother.
"There was nothing to indial
that she tried to kill her babyrl
didn’t want her baby,” said BetrJ
"It’s a pathetic situation.”
Martinez’ attorney, Ra\ Mwl
gomerv. said the woman didn't kiwi
enough about child care to feedi.J
infant properly.
“I think this is nothing moretlii|
a case of ignorance,” Montgomw|
said.
He said that fie persuaded his4|
ent to plead no contest liecanselil
feared that her case would angerf
trial jury and she would be founc
guilty.
Beers, on the other hand,saidfet|
was af raid a jury would take pint
the woman and acquit her of ikl
crime.
Martinez’ pleading and her senl
tence came as the result of a pfol
bargain.
The dead child. Rosa Linda Spoo
nemore, was born in October,
and died in January, 1983.
An autopsy showed she had re
food in her stomach at death, andi
medical examiner ruled starvationa
the cause of death.
At the time the child was bom
Martinez had four other children
none of whom were malnourished.
Parental rights to these childret
were severed, and they were take:
into to custody of the child welfare
department.
Montgomery said Martinez eaw
birth to still another child while i:
jail and has retained custody of that
child.
Martinez’ husband, Benito
Huerpa Martinez, a 38-year-old h
borer who routinely works 12-how
days, did not know the child wasbe
ing undernourished, attorneys said.
Mr. Martinez initially was charged
in the death, but the state later dis
missed its case against him.
