Judge I.D. McMaster described the news reports on the slaying and the parents’ refusal to testify as “overdone.” _ newspaper stories, radio news scripts and television videotapes concerning the case before ruling to move the trial. He said no trial date will be set until he finds another court in which to hold the trial. “I’m in contact with various and sundry places,” he said. “I do not yet know whf tere we are going. “I don’t blame you all,” McMaster told reporters after the brief hear ing. “You’ve got your job to do and I’ve got my job to do. Tm trying to get this guy a fair trial.” McMaster also ordered Port, his attorneys, his parents and their at torney not to talk to reporters about torney not to talk to reporters about the case “in any way, shape or fash ion from this point forward. The judge said that while he be lieves David Port can get a fair trial in Houston, he does not want to take the chance of a second trial being or dered on appeal. Port is charged with murder in the June 7 shooting death of Debora Sue Schatz, 23. “Obviously we want to do the best we can to obtain a fair trial for your client.” McMaster Monday also barred prosecutors from using as evidence several items found in Port’s home and in his car that defense attorney Jack Zimmerman argued were ille gally seized because they were not named in a search warrant. After winning his request for a change of venue, Zimmerman said, “I can’t tell you how pleased we are in the Port case because the judge is sued a gag order.” Much of the news coverage on the case has centered on the suspect’s fa ther and stepmother, Bernard and Odette Port, who went to jail for re fusing to testify before a grand jury about the slaying. Police have said bullet holes and blood found in the family’s home and evidence found in the teenager’s car indicate Schatz was killed in the house and transported in the car’s trunk to a wooded area. McMaster studied more than 700 The couple were jailed Sept. 12 for contempt but Bernard Port was freed Nov. 9 after meeting with the grand jury. His wife remains in cus tody because she has refused to an swer six of the panel’s 200 questions.
