The state’s highest criminal ap peal court ordered a new trial for William Edward Cortez, who was convicted of the 1975 shooting death of Carry Whitely. Whitely was shot three times while li ving to stop a restaurant robbery in Corpus Chnsti. The new trial will be the third for Cortez, whose first conviction for capital murder was overt lined on grounds his previous convictions were improperly allowed into the re cord. In his second trial, Cortez was sen tenced to life in prison for the slay ing of Whitely. The Court of Criminal Appeals ruled Cortez was entitled to a third trial because the prosecutor made improper arguments to the jury. “You have a chance right now to cut this cancer cell out of this society and hopefully save it (society),” for mer Nueces County District Attor ney William Mobley told the jury. “It is up to you 12 people. Now, the only punishment you can assess that would be any satisfaction at all to the people of this county would be life (imprisonment).” The court ruled Mobley’s argu ments were improper and prejudi cial. “Jury argument by a prosecuting attorney that is designed to induce the jury to convict the defendant or * Key want ■“If he c Nt braska Bdnesda ■“Every said he hai assess him a particular punislmii 11 ' t|() dy, because The people’ desire such.Bv * ln( ^ impropei jur\ ai'gmiH-ni.ThecoiiiB n ^ iaL said.
