“You have the right to remain si
lent. Anything you say can and will
be used against you in a court of
law...”
Everyone has heard a television
policeman recite those familiar
words while making an arrest. Crim
inals, however, are not the only peo
ple who must be concerned with le
gal rights.
Anyone ignorant of arrest proce
dures can talk his way into serious
trouble — even if he is involved in a
traffic accident.
“Many people are misinformed
about their rights,” Bryan Attorney
Hank Paine said. “There is no re
quirement that any officer read you
your rights at any time unless you’re
going to be interrogated while under
arrest.
“You are considered under arrest
when you’re effectively detained
from leaving the scene. Any infor
mation you volunteer may be used at
your trial, even if you haven’t been
read your rights.”
Paine offers the following advice
to anyone involved in legal prob
lems:

TUCSON, Ariz. — An Oklahoma
detective tried unsuccessfully to re
voke the parole of a California sex
offender two weeks before the kid
napping of an Arizona girl, a Tuc
son newspaper said Wednesday.
Frank J. Atwood, 26, a Los An
geles County resident, was arrested
Sept. 20 in Kerrville for the abduc
tion of Vicki Lynn Hoskinson, 8,
who disappeared from a suburban
Tucson street.
The girl’s bicycle w^s found aban
doned Sept. 17. A massive air and
ground search in the desert near
Tucson was unsuccessful.
Randy West, a detective with the
Enid, Okla., police department, said
he tried to warn law enforcement
agencies in Tucson Aug. 30 that At
wood might become involved in a
child molestation.
Court documents said Atwood,
who was visiting in Enid, told a po
lice informant he was seeking a child
with whom he could have sex.
California failed to respond to the
request that Atwood be picked up,
West said in the Tucson Citizen.
West’s request for arrest was con
sidered invalid because Arizona offi
cials believed Atwood was back in
Los Angeles. He wasn’t.
In Sacramento, Robert Gore, a
state corrections spokesman, said it
was not until Sept. 13 that parole of
ficials realized Atwood was out of
the state.
A parole revocation warrant ret
roactive to Sept. 13 was issued Sept.
21, one day after Atwood was ar
rested in Texas.
Atwood remains in custody in
Bastrop County facing extradition to
Tucson.
In California, Atwood served three
years of a five-year prison term for
kidnapping a 7-year-old boy whom
he assaulted sexually.
A court affidavit by a Pima
County detective indicates that on
the day Vicki disappeared, witnesses
spotted Atwood with a bloody shirt,
bloody hands and a knife, and said
he had acknowledged being in
volved in a stabbing.

ments such as “I just didn’t see him”
or “I only had one beer” will damage
you in court.
• When an officer arrives, give
him your name, address, driver’s li
cense number and insurance papers.
Cooperate, but do not make a
statement about the incident until
you’ve talked with a lawyer. Let the
witnesses make the statements.
• Don’t let the officer talk you
into making a statement by prom
ising you a more favorable report
with the prosecutor. No matter now
much he wants to help you, the offi
cer has no authority in the prosecu
tor’s decisions.
• Should you decide to discuss
the incident with the officer, you
have waived your right to remain si
lent. However, you may still end
questioning at any time.
• Contact a lawyer as soon as pos
sible. If you can’t afford a lawyer,
one will be provided.
