NEW ORLEANS — A federal ap
peals court Tuesday overturned a
judge’s refusal to grant relief to 17
former Natchitoches Parish deputies
who were fired by newly elected
Sheriff Norman Fletcher in 1980.
The 5th U.S. Circuit Court of Ap
peals, citing its own change in a deci
sion involving a similar case in
Texas, ordered the federal district
judge to hold further hearings on a
suit brought by the 17 former dep
uties.
The deputies all worked for Sher
iff Sam James, who decided not to
seek re-election in 1980, and assisted
Chief Deputy Boyd Durr in his cam
paign to succeed James.
The deputies donated money,
painted signs, displayed bumper
stickers and held a barbecue for
Durr, the circuit court opinion
states.
Fletcher defeated Durr in the
election and fired the 17 deputies.
Fourteen other deputies were re
tained, the opinion says.
The 17 fired deputies filed suit,
claiming they were deprived of their
constitutional rights to political be
lief and association.
But the district judge — who is
not named in the circuit court opin
ion — threw out the suit, bhsing his
opinion on a decision by a three-
judge panel of the 5th Circuit in a
similar case from Jim Hogg County,
Texas.

Jury hears testimony
in adoption-war case

FORT WORTH — A supervisor
at the Edna Gladney adoption center
testified Tuesday a 19-year-old
unwed mother saw her baby a total
of only 20 minutes after delivery,
and willingly released custody of the
infant.
“The baby was born; seven days
later she signed an affidavit” hand
ing over custody to the adoption
center, said Kay Penn, a Gladney su
pervisor.
Patricia Ellen Breeding claims the
Gladney Home coerced her to sign
away her custody rights to her
daughter after she gave birth at the
home on Jan. 20.
Gladney attorney William Schur
counters that Breeding willingly
signed the papers and that she has
presented no evidence that she was
coerced.
“She told nobody she wanted to
keep the baby,” Fenn testified. “The
following day she went home to
Shreveport (La.).”
State District Judge Frank Sulli
van earlier this summer ordered the
child placed with an adoptive cou
ple.
Attorneys for the Gladney home
asked Aug. 31 for a summary
judgment against the*\voman, but
Sullivan last Wednesday granted
Breeding’s request for a jury trial.
Breeding said officials at the
Gladney home had given her the im
pression that because they assisted
her during her pregnancy, she was
obligated to relinquish custody.
The entire circuit court this year
reversed the panel’s ruling in the
Texas case, leading to the call for re
consideration of the Natchitoches
Parish case.

MISDEMEANOR THEFT:
• Someone scratched the paint on
a 1983 Ford Mustang in the post of
fice parking lot.
• A blue bicycle chained to a
lightpost in Parking Annex 50 was
stolen.
• A blue Huffy 10-speed bicycle
was stolen from the bike rack outside
Keathley Hall.
• The back wheel was stolen from
a Raleigh 10-speed bicycle chained
to the bike rack outside Sbisa Dining
Hall.
• A brown Huffy Express 10-
speed bicycle wds stolen from in
front of the Herman Heep Building.
• A maroon backpack was stolen
from outside the Memorial Student
Center Bookstore.
