Bernard and Odette Port spent only a few hours in the Harris County Jail, ordered there by Dis trict Judge William Hatten who held them in contempt of court for not testifying in a grand jury investiga tion of murder charges against their son, David. The Ports are claiming parent- child privilege in their refusal to an swer the panel’s questions. David Port is charged in the June 7 shooting death of mail carrier De bora Sue Schatz, 23. Hatten fined the Ports $1,000 and ordered them both put in custody Wednesday morning “until they agree to appear before the grand jury.” Hatten refused attorney Randy Schaffer’s requests to have the Ports remain free on bond until he could present arguments before the Texas Court of Criminal Appeals. The judge also would not permit Mrs. Port to remain free 24 hours or delay the time the Ports had to re port to authorities until 3 p.m. Wednesday. Schaffer had sought the delay to give the couple time to make arrangements for their son, who is free on $20,000 bond. “There is no reason to lock up the parents and leave this boy unsuper vised,” he said. But Hatten said to release the Ports would violate the intent of the law. “If I did, and I believe I would be wrong if I did, I would be defeating the very purpose of the contempt charge,” Hatten said. “They will go into custody immediately.” Afterwards, defense attorneys said arrangements had been made with relatives to watch after David Port. Last Friday, the younger Port had waived a grand jury indictment and pleaded innocent to the murder charge. Schaffer had argued that by accepting that waiver, the court had made the issue of the parent’s con tempt moot. But prosecutor Jim Lavine said a : grand jury investigation, and the Ports’ testimony, was still needed to determine if a charge of capital mur der should be considered.
