grain tied up in bankrupt el
evators won a “long hard vic
tory” with House passage
Wednesday of the Bank
ruptcy Court Reorganization
Bill, supporters said.
“I’m elated that the grain
elevator provisions were in
cluded in this comprehensive
bankruptcy package,” said
Rep. Bill Emerson, R-Mo.
“I’ve been fighting for three
solid years to have the bank
ruptcy statutes amended to
clarify the status for farmers
•who have grain in elevators
that go bankrupt.”
Farmstate members of
Congress have been working
since 1981 to help resolve
problems dramatically thrust
into the public eye with the
arrest of Puxico, Mo., farmer
Wayne Cryts for refusing to
tell an Arkansas bankruptcy
judge who helped remove
Cryt’s soybeans from a bank
rupt elevator.
Currently, there are no
standards to determine who
owns grain when an elevator
goes bankrupt.
The House, on a voice
vote, Wednesday approved a
bankruptcy bill that includes
“good grain elevator bank
ruptcy provisions.”
“I feel like we’ve won a
long hard victory,” said Rep.
Dan Glickman, D-Kan. “I’ve
been pulling a lot of teeth of
staff and members of the Ju
diciary Committee hut they
all agreed to put this in in the
hill, largely because the mer
its were on our side.”
Since the Senate already
has passed similar elevator
bankruptcy protections “six
limes,” according to Emer
son, they are expected to sur
vive when House and Senate
negotiators sit down to iron
out differences in their
ruptcy system bills.
